Shanique Myrie
Shanique Myrie

The Shanique Myrie matter is currently being heard before the Caribbean Court of Appeal (CCJ) and is being followed closely by BU. Frankly it appears both sides have been …  By showing itself to be an itinerant court it shows how the CCJ is configured to deliver justice in a region which may require such flexibility given our geographic and economic diversity.

Something however has bothered the BU household since the Shanique Myrie vs Barbados matter with  Jamaica subsequently given permission to intervene. While the CCJ has the jurisdiction to hear an original application dealing with the Treaty of Chaguramas, it does not have the jurisdiction to hear an original application dealing with the civil and criminal cases of assault. BU’s view of the matter is that the alleged assault took place in Barbados and therefore must be heard before the Barbados courts.

Unfortunately we do not get enough debate in the media about matters related to law and how it relates to the day to day life of Barbadians. BU has blogged several times on the subject of adding basic law to the curriculum in our primary and secondary schools. Seized with understanding basic legal concepts will instil our people with more confidence to understand and challenge simple agreements which have become a routine part of living our lifes.

The BU family is comprised of legal minds and the BU household is willing to learn and be guided on this matter from the likes of Jeff Cumberbatch and the gang.

Exactly the point nanci is missing.Who corroborated Myrie’s story. Were statements led to substantiate either by visual or circumstantial evidence what Myrie said? And Myrie was found lying more than once so in a court she would be treated as a unhelpful witness

  2. @Gabriel ”advent of that faculty in ’72 or ’73,Jamaicans,Trinidadi”

    ——
When I was in secondary school, shortly after that time, there were already boys at school smoking pot, including the ‘well to do’, at lunch.

So, you say that violence, bullering etc etc and general witlessness is because of the Jamaicans?

Was Dr.Rat a Jamaican? Was Buddy Brathwaite a Jamaican? Were all a dem lil boys smokering de ganja at school, Jamaican? Did Cammie get his alleged bullering from Jamaica?

Remember, some Jamaicans don’t like ‘batty men’ and some go to violent lengths to prove it. Note I say some, because as with any nations, there are the enlightened and then there are the ignorant.

I do not think your assertion constitutes a prima facie case at all.

You are jumping to 1+1=5., absolutely your reasoning has gone off the deep end.

  3. too many hung up on the “cavity search” when the most important issue is why was she not allowed entry after being given approval by the chief immigration office . Isn’t the immigration officer duty to catch such discrepancies why such a big glaring oversight on his part, these are the questions that should be asked as to how could her passport be stamped in the first place for entry

  4. Turning back Myrie on the basis of a suspect intended address does not excuse the alleged cavity search.

  5. David some people just don’t get it. A cavity search is sexual assault if there is no overwhelming evidence that the person is carrying drugs.

Would any of these idiots like this to happen to their family?

Thinking of your own family puts things in perspective.

Hants You are quite right that a cavity search in those circumstances would be sexual assault. As such, it would be a criminal offence and not a violation of any treaty. It should therefore have been tried in the criminal courts in Barbados. Not this fantastic waste of time and money to give an underemployed CCJ something to do.

Spot on.This matter should have had its genesis in a magistrate’s court.Only a gravedigger starts at the top. The Treaty did not envisage this mockery of justice.I am sure the Treaty would have been expected to pass judgements on trade disputes and that kind of area of doubtful judgement by the States of Caricom. Can you imagine the Superior Court of the Caribbean being so idle that they can find time to tour an airport looking at physical facilities because of one stupid lying Jamaican woman of double character looking for easy money aided and abetted by a poor ass Jamaica Government looking to boost its foreign reserves with a ‘cost award’ to help repay its billion dollar IMF loan. How low can you go!And Caricom legal team putting in their 2 cents worth when there is such rampant discrimination in the hiring practices of the Guyana and the Trinidadian governments and they are all silent on all the theifing going on in those two Caricom ungovernable East Indian states of the Caribbean. No court can tell a sovereign state who they can let into their country. If that is the case let Caricom and the CCJ lend this Stuart government money to help run this country which is going downhill every minute of the day.The lying ministers and now the Chief Banker is caught up in the deceitful intrigue. The facts were there for all but the blind to see that projections of Tourist arrivals for Winter 2012/13 were not creditable enough to put Barbados on any growth path. The forecast is now no growth in calendar 2013.If I were the BLP I would say nothing on the state of affairs in Barbados. When the BLP was warning Barbadians of the dangers ahead and what they would have done to correct the failures of Stuart and Sinckler, the party was ridiculed.Let Boyce,Stuart,Sinckler and Estwick get the country out of the mess they have made of our economy.A rehash of 1991.

With all due respect to you,I recall in my frequent travels that Peter Morgan, the Minister of Tourism ’71-’76 had a large sign erected in the arrivals hall at Seawell Airport which said something like”Barbados has no drug problem. We want to keep it that way” or some similar message.I repeat the social deviants called rastafari and the mind altering drug called cannabis, marihuana, ganga, pot, hemp or by whatever name the dope is known, only became familiar to locals post 1972/73 and it might be coincidence but that was post establishment of the Law faculty which saw a regular influx of Jamaicans to Bim.Prior to that Jamaicans had no interest in this area of the Caribbean Archipelago.

  9. Gabriel Tackle you are an idiot. Nothing you said made any sense period. My mother once told me ” boy de more education you get de more stupid you seem to become”. I wish to say the same to you. That is the most foolishness I have come across in a long time. Dumb, dumb, dumb. Your entire contribution simply belittled the intellegence of all Bajans by insisting that a few students corrupted Barbados. Again dumb, dumb, dumb.

  10. A young jobless woman arrives in Barbados for a “vacation stay” with $250 to her name – and the person she gives as her hostess denies knowing her and admits to fronting for a friend.
Bushie can’t understand what the hell this is all about…all like now so the bushman would be searching behind her colon….

No wonder we are the laughing stock of the region…

…and is the CCJ seriously considering getting involved in the details of where a customs officer or police officer choose to search…? Caswell is right, they obviously don’t have a shiite to do…

…so after a suitable ruling from them….would it mean that drug dealers now have a free pass with any drugs they can conceal up their cavities?

If the CCJ judges are short of work why not let all regional High Court cases over 2 years old for ANY reason automatically revert to the CCJ for adjudication?

    Jenkins is much too small……

@Bush Tea, Caswell, and Gabriel Tackle, inter alia,

I suppose that each of you know much better than the appointed judges whether or not they have jurisdiction in this matter. I do not agree with your views. But the point of jurisdiction is only taken by a court if it is raised. Why do you not get in touch with the attorneys involved in the matter and apprise them of your opinion?

I am sure that at least one of the sides will be grateful for your advice.

So Shanique is still suffering from her ordeal and should be awarded a million bucks, according to her lawyers .
She does not display this suffering on Facebook, and appears to be lapping up the publicity.

I came back to Barbados on vacation in 1973,from the European continent where marijauna/ grass/ shit/herb/ hemp was relatively easy to come by , and yes that airport sign was very prominent.
When I got home and was laying on stories of my travels to the boys round the corner, when I got to the topic of drugs and mentioned marijauna, thinking that I was talking to some innocent lads, a friend pulled a match box out of his pocket and asked me, “You talking bout this?”,revealing some fresh marijauna.

    @Just Wondering
Your Mum was clearly perspicacious. It takes just one or two dumbies to spread disease and over time you have a situation similar to what the Nepalese have done to Haiti and the Caribbean..re introduce that dreaded thing called Cholera.
Then you have this dreaded experience in Barbados called the DLP.Don’t know their proverbial arse from their elbow and pretend to know answers when they are not properly briefed by their economic advisers who themselves don’t know the precriptive remedy demanded. They will go on borrowing on current account until one day it all comes crashing down around the citizens, led like a lamb to the slaughter by the pastor of a marchfield church of god.

  15. @ Jeff
You must know that the bushman is totally uninterested in the legality of the issue….Bushie is on about the COMMON SENSE involved.
These two are regularly mutually exclusive in nature.

In these days of drug smuggling where all conceivable means are being employed to move illicit materials around the world, ANY country that would compromise the methodologies of its immigration, customs and police officers by court intervention could only be described as imbecilic.

If Bushie decides to go wondering around a known drug area in the dead of night dress in a hood then they can be no surprise if patrolling policemen stop, search and strongly suspect the bushman of nefarious activities….

What does an unemployed woman with $250, no job, no above board contacts in Barbados, and no good reason to be on such a position expect….? An honour guard? A red carpet?

Obviously the officers would have been convinced that she had some unknown REAL reason for coming here under such circumstances… THAT IS WHAT WE PAY THEM TO DO!

This has NOTHING to do with what some idiotic law written by clueless politicians actually says….

Here you go with this condescending crap again. Granted, you might have superior legal knowledge but you are not all-knowing. If the attorneys had raised the question of jurisdiction and the submission was accepted, the case would have ended and nobody would be getting these big fees for all this work.

Judges should not be idiots and can come to a decision about having jurisdiction without having to rely on submissions from lawyers. This case has nothing to do with free movement of Caricom nationals. If you were paying attention to the evidence, you would have heard that initially, Miss Myrie was granted a visa to stay in Barbados. There goes your argument about free movement. That visa was subsequently revoked when it was discovered that she had lied to gain entry.

This is the point where I started to have problems with the action of the immigration officers. She should have been arrested for lying to an immigration officer and taken before the court. The officers were too humane and instead of charging her, they opted for a simpler procedure where she was returned to Jamaica the next day. No good deed goes unpunished.

  18. What haters what?
The average visitor to Barbados is welcomed with open arms and made to feel more at home than in MOST other countries.
Grantley Adams is as welcoming an airport as the best anywhere.

…but common sense tells you that if you fit a clear profile of someone with a hidden agenda, then the authorities will try to find that agenda…..or at least have an exhaustive look….

She should have been in a position to support her expected stay, or given the TRUE name of the person she was coming to visit and explain why he was prepared to stand the real cost of her stay here….

Uncorroborated accusations of assault from upset women against those who have upset their schemes are not unknown in the anals of history…..

  19. Gabriel Tackle Avatar

And we all know the inherent danger in stopping to give a needy lady a lift in your vehicle.Given the incentive she might start hollering rape, renting her garments in the process and an unsuspecting policeman would simply arrest you.A good beating and questions later in a properly constituted court of law and Jeff would say ‘let the law run its course even if you happen to be in the right place at the wrong time’

  20. Gabriel Tackle Avatar

The word should be ‘rending’ and not ‘renting’

Bushie you keep disrespecting women and one day someone might just search behind your colon wid a 2×4

How many of wunna went to the USA pon a vacation stay and lied to the US immigration on how much money wuuna had and where wunna gine stay and went elsewhere? How many of wunna tek likkle wuk while up dere to get extra shopping money. How many of wunna overstayed wunna time?

Any country can refuse anyone BUT that does not give them the right to cavity search them based on not having enough funds.

As a young woman travelling through other Caribbean countries I have stayed with people and not personally known to me. I have housed guests from the islands and not personally known to me It was through friends that these arrangements were made and in turn I made friends that way. On my first visit to France I stayed with strangers and we became friends some 30 years ago.

  23. @islandgal

The US immigration form ask if you are travelling with more than US10,000.00.

The issue here is not that Myrie lied about the money she traveled into Barbados with but the fact that she declared only USD250.00. Whatever defense you mount there is no proof except Myries’s word that she was cavity searched.

  24. the immigration officer initially stated in written statement that he was satisfied that myrie was staying with pamela clarke and the funds was reasonable for eight weeks stays granting her entry into barbados. Moreover the police officers who interviewed myrie stated that they never suspected myrie as drugstherefore there was no need for cavity search.

  25. Many years ago I entered the US and was asked how long I was staying, I told the immigration officer 1 month, I was asked how much money I have on me, I told him 500.00. He told me that wasn’t enough to sustain me, I told him I was staying with family and that will not be a problem. I was allowed in and given 6 months.

  26. @islandgal

And in this case the Barbados authorities did same and allowed her entry. Based on what has been explained the intended address was revealed to be questionable and entry consequently revoked.

  27. David the intended address should have been checked at immigration at the point of entry. She was allowed in, it was not the part of customs to query where she was staying and with whom. Their job was to check her bags for illegal contraband and not finger rape her!

  28. @islandgal

Did you follow the testimony of immigration officer and her superior who detailed the circumstances which led to Myrie being escorted upstairs?

  29. @ Islandgal
Read back your posts here and see if you can figure out why Bushie “always seems to be disrespecting women” to you….

  30. @islandgal wrote “Many years ago I entered the US and was asked how long I was staying,”
Did you have a visa to enter the US?

  31. Bushie you and your ilk will find all kind of reasons to support your claim in disrespecting women.

Those of you who are calling this young woman a whore must surely have whores in your family in order to recognise one.

Island girl is such a colossal jack ass.Very vulgar,class-less and ignorant.Reading her comments makes you feel as though you are swimming in sewage. Some persons here criticise AC who although sometimes make unintelligble comments at least more often than not she is not as crass as this island girl.

Her comment at 10th April 6:55 a.m. reveals her total ignorance.

Sometimes it is necessary to speak truth to power, some here who flatter her need to really stop making laughing sport and tell her to up her standard and her bitterness of all things bajan.

Clean up the filth and ignorance.

  39. There cis eniough to suspect thatsomething is “rotten in Denmark” starti with Reid intial statement to police where Reid stated that he had talk to Pamela Clarke by phoneand that he had done an investigation satisfying any concerns about Myrie host or place of abode. On cross examinations rechants the statement. Now another problem the security cameras in the invetigation area suddenly doesn.t work. And what about Daniel Forde the only person that talks to him is Gittens.Something is wrong with this picture

    @Island
I am afraid I agree absolutely with Common Sense and his assessment of your character.A woman must always be a lady.A man is expected to be coarse and rough but some prefer soft and mild mannered men called gentlemen. Those in the theatre know all is acting and for you Island ,it is clear you are untrained in the niceties of grace and charm.I thought beating up your Dad was a aberration but clearly you did’nt attend finishing school and so you are now being given a lesson in manners. There are some places a lady should never go.One is in the gutter but then again some are equally at home there along with the rats and sundry vermin.Get up woman!!Walk away.Go and sin no more.

  41. Don,t expect nutting better from Bush tea .The old geezer is a nincoompoop .

Tacky Gabriel……This is where I found you and this is where I left you!

  43. I see many here are holding forth on the duties of Customs,Immigration and Police officers at Grantley Adams Airport. You have no idea of the sweeping and awesome powers of these above mentioned public officers. They are extremely powerful when on duty and some even off duty.Take some time to read the various Acts conferring the power of the crown to bring any suspect to heel and you’d be shocked.A customs officer once informed me that he can search my home up to 7 days sfter I arrive on the island if he has reason to suspect that I lied to him.A police officer told me that refusing to obey an officer in uniform is an arrestable offence. An immigration officer can cancel on the spot any visa you might have allowing you entry into Barbados and order the airline who brought you in to take you back out immediately. If Myrie was processed completely while the aircraft which brought her was still on the gate, chances are she would be put back on board and that would have been the end of it..I still can’t get over the experience that the highest court in the Caribbean is hearing a stupid Jamaican woman say she was cavity searched and they hear her in a formally constituted court setting.Banana court this CCJ thing. It’s a bloody embarrassment. Can you picture judges of Her Majesty’s Judicial Privy Council touring Heathrow Airport because some scumbag from a ghetto in say Dublin claimed she was cavity searched and treated harshly and inhumanly by an immigration/customs/police officer?

  44. Since I cannot be called a Lady please address me in future as Baroness islandgal RFLMAO . Tacky Gabriel and commoner you all are too funny! Playing wuuna is Miss manners bout here. LOLLL

  48. I wonder whether Barbadians in general believe Shanique Myrie. Would someone please comment on what people are saying in the streets.

  49. David,
Up to the point where Shanique was found to be not telling the truth, about her contacts with her intended host, most of the people that I came into contact with, were leaning on the side of Shanique, believing that our people at Grantley Adams were capable of anything.
After Ms Myrie backtracked a statement ,when cross examined by the Bajan lawyers, the consensus was , “What else is she lying about?”

  50. Judging from most of the above comments, it is safe to assume Bajan are 100 % truthful when they fill out the customs declaration form . As Dr. House says : “everyone lies”. It seems that the right to lie is reserved and come April 30th when the taxman cometh, more lies. Now , if only the Inland revenue and VAT department can cavity search.
