In light of the decision by a Staten Island, New York grand jury to return a non-indictment in the Eric Garner death case, CGID has called on New York Governor Andrew Cuomo and New York State Legislators to enact changes to NYS Public Service Law and Criminal Procedure Law (to be known as the Garner Law) to assure a fairer, more equitable and transparent justice system. Following is CGID’s letter to the New York State officials.

Dear Governor Cuomo:

The failure of the Richmond County (Staten Island) grand jury, under the direction of republican District Attorney, Daniel Donovan, Jr., to indict NYPD officer Daniel Pantaleo for using an illegal choke-hold to kill Mr. Eric Garner, has brutally diminished the credibility of the criminal justice system.

The occurrence of Police officers killing Black men with impunity has become pervasive. This has now enlightened the American people to the vulnerability of African-American men to prejudiced law enforcement officials and prosecutors who; in certain instances, manipulate procedural law and judicial instruments to attain certain pre-determined outcomes.

This oppressive juggernaut is responsible for the death or incarceration of a generation of Black men. This must not be allowed to continue, for it is an atrocity and gross human rights depravation which all Americans must reject.

The failure of the grand jury to indict officer Pantaleo is inexplicable. Clearly, there is probably cause to believe that officer Pantaleo committed a crime. The substantial body of prima facie evidence available establishes that either he intentionally or recklessly caused Mr. Garnerโ€™s death. This horrific crime was witnessed by dozens of unbiased citizens and captured on video tape, and the Medical Examiner of the City of New York ruled that Mr. Garnerโ€™s death was a homicide.

In the face of this incontrovertible evidence, why did the grand jury โ€œnotโ€ return a true bill for an indictment?ย  What went wrong?

(I) Although within his purview, D.A Donnovan refused to directly indict officer Pantaleo. Had he done so, the case would have taken its natural course with an ultimate trial, as is done each day in every other case.

(II) The leaks that have emanated from the grand jury thus far suggest that Mr. Donnovan may have engaged in a charade grand jury process, which he potentially used to concealed congenital prejudices, and may have designed submissions to induce a predetermined outcome โ€“ a non-indictment or “no true bill.”

(III) There is a proliferation of cases all across America where prosecutors, who do not genuinely wish to indict or prosecute Police officers who kill black men, supplant jury-trials with secret grand jury investigations. These proceedings turn out to be de facto trials. Prosecutors dump incriminating and exculpatory evidence, forensic evidence, expert testimony, as well as legal theories and statute before this panel; then misguide them to use the standard of guilt or innocence to determine whether or not to indict. This appears to be true in the Eric Garner case.

(IV) This is an abuse of the grand jury process that fundamentally changes the fairness and configuration of the American justice system.

(V) A grand jury is not a trier of fact or finder of fact. The singular purpose of a grand jury is to investigate the potentiality of criminal conduct and determine if there is โ€œprobable causeโ€ or a โ€œsufficiency of evidenceโ€ to institute criminal charges.

(VI) The practice of trial by grand jury is unjust. It skews the process in favor of, and awards special treatment to, Police officers. Ordinary citizens do not get this privilege.ย  Therefore, this practice potentially violates the equal protection clause of the US Constitution.

(VII) Clearly, our community is disgusted with the phenomenon of police officers killing minorities with impunity. This nefariousness design is enabled by certain prosecutors who use grand juries to obfuscate their intent to decline indictments in these circumstances.

In order to terminate these unjust practices, there must be immediate reform. Consequently, the New York Caribbean Guyana Institute for Democracy (CGID) proposes the enactment of the Eric Garner Law. This provision envisions amendments to the NYS Civil Service Law, Criminal Procedure Law, and other relevant laws, to mandate that:

(a) New York City Police officers must live within the five boroughs.

(b) Police officers who are convicted for killing unarmed citizens must be personally liable for their own civil penalties.

(c) Police officers cannot use deadly force in situations where unarmed suspects pose no threat to themselves or others; must employ non-lethal methods to subdue unarmed, non-violent subjects and, must be thoroughly trained in these areas; including de-escalation tactics.

(d) In cases where alleged Police abuse or misconduct result in death or serious injury, the District Attorney of the County โ€œmust,โ€ after an investigation, either exercise his/her deliberate judgment to indict the subject officer and refer the matter for a preliminary/probable cause hearing before a judge, or, after an investigation, refer the matter directly to a judge for a preliminary/probable cause hearing.

(e) The defendant may cross-examine adverse witnesses and may introduce evidence at the preliminary/probable cause hearing but shall not be permitted to object to evidence. If the judge finds probable cause to believe a crime was committed, the defendant shall be indicted to stand trial. If the judge finds no probable cause to believe the defendant committed a crime, the judge must dismiss the complaint and discharge the defendant.

(f) Transcripts of all grand jury testimonies must be made public upon a motion for released which shall be heard and determined by a justice of the New York Supreme court.

We believe that these changes if enacted will help to make the justice system fairer and more transparent, and will help to restore a level of trust in our criminal justice system.

Mr black here where we differ…I have already said I feel sorry for how mr garner died however if like you say he said I cant breathe 11 times he was getting air from somewhere, I believe it was some one compressing his back that killed him not someone choking him , as I had a friend who was accidently killed by a large cop trying to stop him hurting himself why having a seizure and sat on him stopping enough air to reach the lungs which caused a heart attack. It really doesn’t make a difference but I hate when people point to specific events that caused all this protesting rather than the real reasons it is happening. Barkley was right when he said if you don’t agree with your community you are called an uncle tom. How can anything be solved when people of both sides cant have a dialogue about race when if you see merits to the others argument you are branded by your own.
    AC I am truly sorry no white man has taken you on which may account for your jealously , but I have found there is a lid for every pot, so don’t give up hope you probably are too much of a mutt to get a white tiger but maybe a white elephant.

He doesnโ€™t speak for the Black community in America. Now, I am quite sure if his comments regarding these incidences were to the contrary, he wouldnโ€™t have gotten any airtime Lawson.

And as I write, the police officer who is culpable of this unspeakable act still walks the streets of New York a free man. Now, shouldnโ€™t Mr. Garnerโ€™s widow and children be entitled to some kind of justice as well as compensation for the culpability of this officer? Well, it certainly appears as though the Black manโ€™s life is of no real value and worth in the United States of America Lawson. But try as you may, to advance your straw-man arguments to justify the entrenched bigotry which envelopes the predominantly white police establishment throughout America, but I am not buy what youโ€™re selling Lawson.

    That sounds really wonderful as a concise sound-bite verdict on cross-racial interface, but it’s unfortunately a clear realization of how difficult it really is to categorize race and present day affiliations.

    There are so many black-men (Pres. Obama. most prominent example) and women who would have to label their mothers or fathers, or a favorite grandparent or uncle as the ‘enemy’ if we take your nice little remark seriously.

    Nothing sir is so cut and dry today.

    Many families are inextricably linked black & white and that’s why it’s absolutely crucial that the race debate be reasonable and devoid of hate simply for its sake.

    I can dislike my nephew because of his racist beliefs and clearly let him know he is not welcome at my house; it’s absolutely unacceptable for me to hate him because my brother married a white woman and has a white son. How racist would I be!

  16. as crazy as might comment might seem to some,, recently i came across a video which got into detail as to why bill cosby after all these years as portrayed as the wholesome exemplary all american dad for black was being kick and punched in the media by the white establishment that put him high on the pedestal now only to find himself left hanging out to dry, it sounded like a story made out of fiction and crazy as sh,ite but the method and the events behind all that is now happening to bill cosby was as crystal clear as my comments were meant to be.

You should take some time and read about the Black men and women who once comprised this organization. Their main objective in the 1970โ€™s was to attack police stations and kill as much white police officers as possible. Now, I am not glorifying this organization, but as Malcolm X once said: Freedom and Justice for Blacks in America must be attained by any means possible.โ€ I am sure you have heard of Angela Davis, who spent many years in exile in Castro Cuba?

    I don’t know why Bill Cosby’s misdeeds are now being aired publicly but it’s rather remarkable that the ‘white establishment’ is to blame.

    Cosby’s work as the awesome father figure on TV has served many of us well as an excellent model; that history will not change.But certainly there is no future impact for him.

    But considering that it was the ‘white establishment’ that he relied upon to build his fame and success; and the ‘white establishment’ that contributed to his protection from these charges years ago when some of them were first raised; and that it was a black comedian who during his act repeatedly made the assertion about Cosby’s rape allegations, comments which seemed to start this current cascade of news, I am unclear what special motive there is from this ‘white establishment’ to destroy him now.

    Mr. Cosby despite these very distressing allegations has done some very great things (scholarships, mentoring programs, large donations to Black colleges etc) to help hundreds of young men and women reach their goals and dreams. That history also can’t be changed.

    If you want to blame the ‘white establishment’ for his current predicament so be it. I believe Bill Cosby would be the person to blame.

    Praise the man where it’s deserved and be honest enough to condemn his actions when they are heinous.

    I know it’s hard for you to disagree without being nasty so I encourage you to review well the underlying tenet of that CIA Senate report: even enemies deserve to be treated with respect.

    I believe several (well a few anyhow) people have come out in support of Cosby. Some blacks like Whoopi Goldberg and others whose race I don’t know. Regardless, I think Lawson has spoken with clarity . “…probably because they think he is guilty.”

    When an entertainment celebrity or otherwise famous person is accused of acts such as this the process as seen over the years creates certain basic assumptions which often prove true.

    In this case, Mr. Cosby has had these allegations thrown at him by persons who took him to court and had their claims settled. Now that does not tell us if he is guilty of anything so, no harm no foul on making any public judgement on that.

    Then others have come forward and accused the man of the same thing. They can’t go to court because they waited too late to come forward.

    Strange thing though is that sameness of crime. So either these women just decided to be lying parrots and jump on a band-wagon, are masochists and relish dragging their names and those of their families through the public glare, they are looking to get a TV deal for a reality show, they are mentally unstable or they are telling the truth.

    So sir, using the filter of pass misdeeds by public officials and how they go about the legal process I would give a verdict of Guilty on the Cos.

    And BTW, it’s beyond interesting that a man who is a PhD in psychology and propagates black upliftment so well had all these alleged liaisons with white women.

    That’s a part of the story that is so interesting. Just like Tiger he is fixated on the pale joys of wonder.

  35. look i am not debating whether the allegations are true or false,,but there is an underlying theme that plays along well with all that is happening and these allegations fits well into the hands with purpose and intent of those trying to destroy cosby .
    Even if these allegations are true,, the silence of those in the white establishment who were friends of cosby speaks volumes ,and to further expand on cosby guilt or innoncent, it is only fair to speculate that those in the white establishment who had perched him up on the pedestal might have known about these stories but would have prefer to keep their mouths shut since cosby had become a bread basket for them.
    this story if it should become unraveled would reveal the many major players as to what they knew or didn;t know and iif the story is not true would tell a damning story once again of how the white establishment would destroy people of colour if they dare cross the line,

    Please tell me when you can recall a celebrity being accused as comprehensively as Cosby has been as a serial rapist and the fair-weather, hangers-on friends DO NOT recede into silence.

    If Cosby needs public support he will organize friends to speak on his behalf.

    There is noting to speculate., You are defining Hollywood since day one. Lawson mentioned the example of Rock Hudson. It’s called a posse, or entourage or peeps or whatever. Among this group are the ones who absolutely know what happening.

    It’s very simple, you are a friend and confidant until you are NOT a friend or confidante. Loyalty is defined by green, status or until the BS hits the fan.

    If this story unravels I would be shocked sir.

    I can agree that one or two of the stories may be not as the lady has described but this Cosby story has that duck quality to it: if it walks like a duck, swims like a duck….

It did something for about 10 years [but] then there was a North-South compact which essentially granted the former the slave-owning states the right to do whatever they wanted; and what they did was criminalize black life — in all kinds of ways — [and] that created a kind of slave forceโ€ฆ It threw mostly black males, but also women, into jail, where they became a perfect labor force, much better than slaves,โ€ Chomsky noted.

    โ€œIf youโ€™re a slave owner, you have to pay to keep your โ€˜capitalโ€™ alive. If the state does it for you, itโ€™s terrific — no strikes, no disobedience, the perfect labor force. A lot of the American Industrial Revolution in the late 19th, early 20th century was based on that. Actually, it pretty much lasted until the Second World War, when there was a need for free labor for war industry,โ€ he pointed out.

    โ€œAfter that come about two decades in which African Americans had kind of a shot of entering [American] society. A black worker could get a job in an auto plant. The unions were still functioning, and he could buy a small house and send his kid to college. [But] by the 1970s and 1980s itโ€™s going back to criminalization of black life – Itโ€™s called the drug war, which is a racist war. Ronald Reagan was an extreme racist — [he] didnโ€™t hide it — and the whole drug war is designed, from policing up to eventual release from prison, to make it impossible for the black male community and, more and more women and more and more Hispanics, to be part of the [American] society,โ€ Professor Chomsky said.

    He further pointed out that โ€œif you look at American history, the first slaves came in 1619, and thatโ€™s half a millennium. That erases the civil war – the Red States were the Confederacy This is a real battle. These two founding crimes – slavery and the extermination of the indigenous population – are very much with us today,” Chomsky concluded.”

    First let me start by telling u that these allegations are not remiss from the hollywood lifestyle black or white and should never be condone or coverup ,however a continuous pattern of” piling on” always reappear by media and others of the powerful white establishment when in instances these allegations are said to be done by black rich and powerful celebrities, ,,as with michaerl jackson.. tiger woods,, O,j, Simpson , and now bill cosby,,,
    the same cannot be said of Roman Polansky a child molester ..and the likes of woody allen another child molester , where in the two named latter the ground swell of disdain appears but quickly disappears ,hence one see these celebrities polanskt and allen given a lower threshold while accused from which they can emerge out of these scandals to continue there lives with little or no disruptive harm or long term damage to their careers ,in the meanwhile the black celebrities the bar is raised so high that there demise is permanent

    Protests are ongoing but have exposed US Racism and fears of Blacks and mindset of White America which need addressing. Protests are comparable to 60’s Civil Rights issues in different shape and form in 2014 and 2015

    Norm Chomsky’s narrative perfectly describes the lastly hideous relationship behind this country and its Black and Ingenuous peoples. Our witness to the State’s public lynching of Eric Garner is a shocking reminder that we are 3/5’s of a citizen in this nation.

    If the white man’s best friend, his dog was video taped being choked to death, there would have been more sympathy and heartbreak for that animal from the majority of white folks than there has been for Eric Garner.
