A dispute involving Irish investor Alan McIntosh and other parties with local hotelier Peter Odle continues to be a source of embarrassment for Barbadians and makes public what ordinary Barbadians have been complaining about for many years. We have a court system that is broken and a ‘buddy system’ that protects the favoured in society. In local parlance, two Barbadoses.

The two political parties come and the two political parties go and the problem remains.

See other blogs posted on a dispute which continues to expose our moribund court system and to dent our reputation as a domicile fit and proper to conduct international business. This imbroglio is occurring as Prime Minister Mia Mottley has been promoting the Barbados Welcome Stamp – Work Remotely in Barbados initiative in the international media. It should not be forgotten that attracting foreign direct investment is important to the economic planners to ensure we can honour foreign commitments.

Alan McIntosh dubbed by Barbados Underground as that pesky Irish investor has written a second letter to the Prime Minister of Barbados which encapsulates in summary detail the dysfunctional governance setup and toxic business ethos prevailing in Barbados. The letter separates the issues for the Prime Minister’s under the headings – Court Delay Tactics, Corporate Governance and Abuse of Personal Relationships to Circumvent Creditors.

It is clear from reading the letter that Attorney General Dale Marshall is also aware of the ongoing dispute that threatens to compromise Barbados’ economic recovery effort. In an Affidavit filed with the Barbados court, Abagi Ekoku who is a shareholder in Sandy Bay Holdings Inc (SBHI) named as First Defendant in the pending court matter, explains how a repurchase agreement with Richard Bradford and Peter Odle has gone south and precipitated litigious action.

Clause 23 extracted from the Affidavit sworn by Agagi Ekoku:

On Monday the 10th day of February, 2020, pursuant legal advice which I received from my Attorney-at-Law, I wrote to the Attorney General of Barbados, the Hon. D. Marshall, Q.C., MP. I requested acknowledgement of my aforementioned letter from the office of the Attorney General and received the acknowledgement on the same date from Hazel Mederick, the executive secretary to the Attorney General. To date, I have not received a response to my letter. True copies of the email/letter dated 10th day of February, 2020 and the acknowledgment of the same date are hereto attached and marked “AE3”.

    Looks like he might end up bringing a constitutional action against the Attorney General for the delays.

    If he gets there, a remedy in damages means the taxpayer foots the bill.

    This is a familiar play book. The attorney general and the courts will delay, the Irish business will go to his government, who will put pressure on the EU to defend its citizens. Barbados will be blacklisted once more, and the idiots will cry racism. They must sort out their incompetence.

    Once again, the BU community is completely misinterpreting a case. Unfortunately, there is a wrong tendency in Barbados to blame all personal mistakes and the mistakes of incompetent lawyers on the Attorney General and the courts.

    Our Irish investor is a small fish in terms of investment volume. If he had better lawyers, he would have negotiated an arbitration clause to the arbitration board from the outset. We also do not know to what extent the delay at SC is attributable to his lawyers.

    Until these aspects are clarified, it is pure speculation to accuse the local justice system of failing.

    A general remark: Powerful investors own a private militia to cope with competitors and a gold treasure chest for bribery. Our Irish investor obviously does not have either. It is his own fault.

    But it isn’t only incompetence.

    Incompetence is a good cover for corruption.

    The Eu is but one avenue.

    There is also IACHR which although it can’t impose a monetary penalty can still make life uncomfortable for the GOB.

    A general remark:

    Peter Odle clearly refutes the racist prejudice of former minister, the Presscott that all influential business people are white.

    There is no God-given contrast between whites and blacks in Barbados, only a cultural-ideological one between successful businessmen like Peter Odle and the masses dependent on social transfers like the drug addict on cocaine.

    Why does this embarrassing debacle continue? Largely because Peter Odle, well known for using the threat/benefit of his ‘contacts’ to delay making payments to others for many years, is finally being unmasked.
    Congratulations to you BU. You are putting our mainstream press to shame and I urge you to keep investigating for the betterment of Barbados.

    Why are you promoting this issue?Is Bu the place to ventilate ad nauseam what is really a private legal dispute which should be handled in the law courts however broken it is? Can you tell me which other country in the British Commonwealth that a private citizen can demand special attention to his private legal disputes from the Head of Government and the Chief Legal adviser to the GoB?. Are you unwittingly encouraging disrespect of our GoB and its chief executive?
    We strain at a gnat of republicanism and swallow the camel of gross disrespect for our country and elected Leaders. Come off it. You can do better. Try doing the same thing in USA or UK. Some foreign ?investors? need to know their place.

    Odle’s predicament remains unchanged from whatever it was two weeks ago or whenever the suit was filed against him. What is under the microscope is the judicial process and the inaction of some officials to pen a simple response to letters of complaint.

    McIntosh is petitioning the Gov’t to speed up the process in order for him to can have his day in Court, don’t see how this puts Odle “under the gun”.

    I agree that there are several areas of our society that have suffered from the lack of maintenance. Our system of providing justice is one of them.It is a system that served the pre-independence regimes well. The post independence regime did not retrofit it but decided to exploit it. It has now become dysfunctional and troublesome.It requires some effort but few are prepared to exert that effort. We only get a lot of noise. We lack the testitudinal fortitude. But it is something to rant about. It is a national mojo.

    Peter Odle is my friend and if the accusations are true it is ” unfortunate “.

    He should resign from the Board of Barbados Ports Inc. and let his lawyers try to resolve his legal issues.

    As usual you zero in on the heart of the matter. We operate in a system where change is effected when it touches certain people. If BU has to hitch a ride to power the battery so that others benefit, so be it. In this case – depends the perspective- it is fortunate or unfortunate Peter Odle.

    Because if the GOB ends up with a hefty bill for damages, the only person from whom it can recoup the loss is the defendant who is being provided with an unfair advantage in a court that “shall be independent and impartial”

    The natives might become restless if the GOB uses their money and does not appear to recoup the loss it has occasioned.

    The only way of avoiding this outcome is to actually provide the plaintiff with a “a fair hearing within a reasonable time” in a court that “shall be independent and impartial” as he is due under the constitution.

    The defendant might actually win but if “a fair hearing within a reasonable time” is being withheld it is a fair bet the defendant is expected to lose and that the court that “shall be independent and impartial” is not.

    Either way, the defendant is under the gun, the GOB too.

    Of course the GOB can stick its head in the sand like an ostrich and hope it all goes away.

    That’s the problem in a pseudo fascist system that is dumb enough to actually have a constitution affording protection to its natives.

    With an unholy alliance between the government and private enterprise in existence (definition of fascism) somebody is going to blow the whistle to stop and will invoke the constitution.

    The trick is to get rid of the constitution or rescind all alliances, well not all, only those which threaten the government.

    Is the time not ripe for the Barbados Bar Association to become an active lobby from within the system? As legal officers Mrs. Rosalind Miller-Smith has to know the responsibility of legal officers to make the system better. If/when it crashes under its wait then what.

    However, at some of PO1 to PO1000 stop being a fight for justice and becomes a personal vendetta. We already have four to five posts on this matter.

    The cry is not for silencing of the PO matter, but for ventilation of the matters/plight of others.

    If McIntosh is not having any luck with his letters to the PM he should up the ante by going over her head and appealing to Elizabeth R before it is too late. As an Irishman he may be reluctant to go to the House of Saxon as they have long memories and may not be in a forgiving mood after what the Irish did to Dickie Mountbatten (Battenberg for the historians).

    That’s my general knowledge lesson for the day.

    O those speedy courts!

    Elsewhere in the news is the case of one Kobia Jamar Robinson who recently pled guilty to a burglary that occurred on August 24,2012. There is no indication of what happened in the eight years that elapsed between the commission of the crime and the guilty plea although one can surmise that the accused was caught quickly since some of the stolen items (including perfume) was found at his home and I don’t think that anyone would keep perfume around for several years waiting for the opportunity to use or gift it to someone.

    Why would the Barbados Bar Association (not the watering hole fraternity) get involved? Delay is a primary legal weapon. Everywhere. S-t-r-e-t-c-h ya out, and hopefully fatigue may alter your determination. It works easily when other cogs in the wheel have rust, and hence delays are seen as less strategic or forced, and merely a product ‘of the system’.

    Police began investigating the matter and on September 9, 2012 they took one of the men who participated in the robbery to the house.

    (1) No person shall be deprived of his personal liberty
    save as may be authorised by law in any of the following cases,
    that is to say-
    (a) in consequence of his unfitness to plead to a criminal
    charge or in execution of the sentence or order of a court,
    whether established for Barbados or some other country,
    in respect of a criminal offence of which he has been
    convicted ;
    (b) in execution of an order of the High Court or the Court
    of Appeal or such other court as may be prescribed by
    Parliament punishing him for contempt of any such
    court or of another court or tribunal;
    (c) in execution of the order of a court made to secure the
    fulfilment of any obligation imposed on him by law;
    (d) for the purpose of bringing him before a court in
    execution of the order of a court;
    (e) upon reasonable suspicion of his having committed, or
    being about to commit, a criminal offence under the law
    of Barbados ;
    (f) in the case of a person who has not attained the age of
    twenty-one years, under the order of a court or with the
    consent of his parent or guardian, for the purpose of his
    education or welfare ;
    (g) for the purpose of preventing the spread of an infectious
    or contagious disease;

    etc. etc. etc.

    @ Tron, no amount of excuses will repair a damaged reputation. If this was the first time that the local jurisdiction was accused of failing, I would say that you have some ground to stand on that its reputation was being sullied. However this is NOT the case. The law Court in Barbados and the jurisdiction already have a bad reputation. It would be good it this matter would be the one to break the inertia.
    While there is no evidence that the AG was advising Mr. Odle, he has not responded to the letter. Since this matter is now in the public domain, he should clear his name because it is all caught up now in the circumvention of the law. Barbados needs an impartial AG as I have stated before who is not associated with or a member of any political party. This is one of the changes that is definitely required for the Republic. Hence we need that Referendum as we do not need the cosmetic change of a figure head.
