The blogmaster has been observing more and more cases of ‘ordinary’ Barbadians seeking justice for inequities meted out to them with the system failing them when they attempt to seek redress. Whether it is the Office of Public Counsel, FTC, FSC, Ombudsman and the others.

In the case of the Justin and Brunetta McIntosh CV1399/2008 matter this is another example – this time – it is the Barbados Bar Association.

The BU family would have read about the plight of the McIntoshes in the BU blog posted in July of 2013.

Not a surprise to the blogmaster, we have had to return to the matter last week:

For the avoidance of doubt to address if the plaintiffs in this matter exhausted the recommended channel (s). See response from the Barbados Bar Association.

When the McIntoshes received the Bill of Cost from attorney Bernadette Callender with 7 days to pay, They referred the matter to the then acting Registrar to solicit advice. After discussing the matter with them, the Registrar telephoned Bernadette Callender in the presence of the plaintiffs.

In summary: Bernadette Callender said if the McIntoshes withdrew the decision to dismiss her as the standing attorney, she would continue the case. Because the McIntoshes wanted to see the matter completed, they agreed.

However, after the new Registrar’s Conveyance was put in place and signed off by the McIntoshes, they received word from Bernadette Callender that she will not be going any further with the case.

The blog of last week highlighted that Bernadette Callender  continues to holds the McIntoshes’ file until she is paid.

Negotiations were made with her to receive money from CIBC FCIB for her services in connection with the foreclosure suit. After the sale of the property, she would be paid monies due after the taxation matter. She consented and promised the standing attorney she would make copies of the files and turn over the originals. The McIntoshes gave consent and she was paid for her services where the foreclosure is concerned. She delivered the conveyance to CIBC FCIB. After that Callender insisted on full payment and advised that she would file for taxation, explaining, that she would be the best person to file because she was the attorney that dealt with the suit.

The blogmaster was advised since 2015 Bernadette Callender mentioned filing for taxation but it was never done.

Bernadette Callender take notice – BARBADOS UNDERGROUND will continue to recycle this matter until there is resolution. The longer it remains outstanding the more familiar Google and other Internet search engines will be made familiar with YOUR name and deed.

    The fact is that the Bar Association is a mechanism that acts like a sandpit that looks like a garden of Roses.

    It is like a venus fly trap which ostensibly has the name of an entity to protect the interest of the public but all it is, is a fraternity of crooks that stroke the unsuspecting public to submit their documentation WHICH IS THEN SHARED WITH THE COMPLICIT ATTORNEY OR ATTORNEYS

    They then go back to their respective lairs AND ADJUST THEIR RECORDS AND HIDE THE CROOKEDNESS

    It is indeed a veritable gangland or thieves and whores who masquerade as officers of the court and upholders of the Law.

    This is why de ole man and me son have been advocating for a different mechanism that will exist offshore Barbados.

    What that virtual compendium will do is permit bajans to upload all of their files on the matter from what they sent to the lawyers, registrar, bar association EVERY SHY$E, so that when a new RH potential victim comes to search our platform YOU WILL SEE DE FVCKERS NAMES LISTED THERE!!!

    That will be the end of every one of the lowlifes (Jackie Stewart’s favourite word) spree.

  5. I wrote to the bar association in January regarding a nonresponsive attorney I was dealing with. I am yet to receive acknowledgement of my correspondence furthermore a response to my complaint.

    Hyde Park attorney David Land Whigham once represented clients who were physically and mentally disabled. He has pleaded guilty to stealing more than $2 million from them.
    thefts were uncovered after Whigham repeatedly failed to distribute more than $900,000 that one of his clients held in a trust for a relative. After the relative died in 2011, the money was supposed to be given to the Shriners Hospital for Children and a schizophrenia research foundation.

    I agree with this post 100%. Some lawyers have not only hijacked the justice system but manipulate the courts by their appearance and non appearances. The Legal Aid system is abused and matters related to children are exploited and prolonged to earn income. Let any lawyer question my mouthings and I will respond with facts.

    Considering that those who eons ago ambitiously exploded the development of that nation by exploring the mineral wealth and by pillaging the lands and taking the lives of the natives were originally Brits and French…and further considering that then after killing each other in civil strife they have forged an impressive UNITED semi-autonomous set of states that if stood up in full autonomy some would be measured as great nations in the world… It’s reasonable to say … 1) INDIVIDUALISM is NO MORE inherent to an American than a Brit or Frenchie and 2) the American has a strong desire for COLLECTIVE power!

    If we continue to mimic American culture we could be a tituliarly and practically a strong unified bunch of yahoos (minor pun intended), libertarians, and all sorts of others ALSO…

    We pretend that everything fell apart between 2008-2018. This is rubbished political nonsense! Since the late sixties, we warned that our culture was being threatened . We continued to copy American corporate culture. We saw how gas stations became mini marts, driving all the small community shops and mini marts out of business. Note that these enterprises were black owned. This made black gas station owners direct competition of black mini marts. Divide and rule.
    Education the same thing. All the black private owned schools have gone out of business . I think the only one surviving is the Metropolitan.
    We educated lawyers who then fitted into the new corporate culture. They now represent off shore businesses who enjoy massive tax breaks etc. This piece here about the Bar Association looking out for the citizens is fit for the dustbin. It’s grounded not in nationalism but in fragile attempts to perpetuate the system disguised as some concern for the poor.
    We go to construction:Cuss Maloney while in opposition but make sure he continues to prosper when the government changes.
    Example:
    Coverly was becoming a ghost town. Extravagant prices made the sophisticated pigeon coops unattractive.
    In steps a medical school. Dozens of black people own houses with rooms and apartments in the Cave Hill area near UWI. Many small businesses . Rather than set up the university in an area that will create economic wealth for those blacks,the same people who cuss Maloney, made sure Coverly reaped the benefits. Then they talk about economic enfranchisement.
    This rugged political individualism is the hallmark of the BLPDLP. They made sure that it became the dominant social behavior.
    They benefit- the same collective lawyer class.

    One cannot seriously dismiss your position. However, I am dealing directly with the fact that American culture is our main influence and we cannot as a country or a region accept the American cultural penetration that is now rampant.
    Furthermore the vision of a Caribbean Nation, must be grounded in our emerging Caribbean civilization. We are not the Wild West!
