Colonialism Reparation welcomes that the International Court of Justice has decided that the process of decolonization of Mauritius has not been lawfully completed and that the United Kingdom has an obligation to bring to an end its administration of the Chagos Archipelago and requests that the United Kingdom present apologies and compensations for the deportation of the original inhabitants and the whole period of British colonial rule.

On February 25, 2019 the International Court of Justice has delivered the advisory opinion Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965 requested on June 22, 2017 by the United Nations General Assembly.

The Court considers that “as a result of the Chagos Archipelago’s unlawful detachment and its incorporation into a new colony, known as the [British Indian Ocean Territory] BIOT, the process of decolonization of Mauritius was not lawfully completed when Mauritius acceded to independence in 1968”.

For this reason “the United Kingdom has an obligation to bring to an end its administration of the Chagos Archipelago as rapidly as possible and that all Member States must co-operate with the United Nations to complete the decolonization of Mauritius”. As regards the resettlement on the Chagos Archipelago of Mauritian nationals, including those of Chagossian origin, the Court was of the view that this is an issue relating to the protection of the human rights of those concerned, which should be addressed by the General Assembly during the completion of the decolonization of Mauritius.

The decision was taken as a full court with thirteen votes in favour and only one against and was immediately welcomed by the United Nations, the African Union, Mauritius, the associations Groupe réfugiés Chagos and UK Chagos Support, the United Kingdom’s Leader of the Opposition and also by Cyprus, which could start a similar path for Akrotiri and Dhekelia, Argentine and Comoros.

  • that the colonizing nations compensate the colonized nations for the atrocities and abuses committed thus allowing an improvement in their socio-economic conditions.

The contribution of every person who recognizes the importance of this activity to the creation of a climate of friendship and cooperation between peoples is necessary and appreciated. This contribution will create an extremely positive precedent in international relations as well, promoting the supremacy of the “force of law” on the “law of force”.

  1. Diego Garcia is one of the Islands in the Chagos Group. The UK handed it over to the Americans who have a large military base there. It is of strategic importance. It allows the Americans the ability to intercept hostile forces from a number of locations In the Indian Ocean and parts of the Pacific Ocean. For example Diego Garcia was the staging point for the Afghanistan war. During the Cold War ,it was very important in keeping an eye on the Soviet’s forces. The British up-rooted the inhabitants without consulting them and resettled them on one of the neighboring Islands. The Inhabitants of the Island have had a court case going on in the UK and the International Court of Justice. Personally, the inhabitants should be able to go back home, but I do not expect that will happen. This is big power politics. The Chinese sixty years ago annex Tibet, if any one thinks China is going to pull out of Tibet, they are really stupid. Similarly in western China where the Turkish Muslims live, the Han Chinese are pouring in by the thousands; soon, the Han Chinese will out number the Muslims Similarly with the Crimea which the Russians annexed because of the access to sea for its naval forces. Similar event occurred in the second world war, when Russia launch an attack on Finland and annexed the only ice free harbor in that part of the world for strategic purposes. Technology and military might will always out trump morals in big countries politics, This is some thing some of the commentators on this blog do not seem to understand.


  2. Dr. Lucas, I appreciate your command of science.

    There is lots of background to this Mauritius decision. First, the people displaced were blacks like me and they were not and still are not treated well by the Indian majority on Mauritius and they received no compensation for their properties. I do not recall any threats stopped by the Americans being in the Indian Ocean. America has created all the worldwide threats in my short life time. Furthermore, you do not attack a country (Afghanistan) to avenge what one man supposedly did, especially when that was not the man’s country (Saudi Arabia). You try him in a court of justice.

    Secondly, Crimea was always part of Russia and was occupied by ethnic Russians. Nikita K. during the Soviet era assigned it to the Ukraine because he was from there. At that time, it did not matter because they were all Soviet States. Russia has always had a naval base in Crimea and they were right to resume ownership.

    Thirdly, if Chinese move from one part of China to another part of China, what is wrong with that? Look at all the people leaving all over Barbados to live in Christ Church and St. Philip.

    I am quite aware that the Crimea was part of Russia and that Nikita K, an Ukrainian, unilaterally did what he did. I used the Crimea as one of the examples when powerful states do what they think is in their interest. I noticed that you have overlooked Tibet and Finland.. Do you realize that the Sino-Viet Nam war of the 1970’s which was launched unilaterally by China, resulted in China annexing part of Viet Nam. The point that I am making is quite straight forward: you can talk all you want about “rightness and wrongness” to coin a phrase, in the end power counts more than anything else.

    It’s not surprising – if you accept that these countries (e.g. UK, USA) will never create international organisations or laws that will turn around and “bite dem in their backsides”.
