PRESS STATEMENT

As the Industrial Relations Consultant to the Prison Officers Association (The Association) I have been authorised by the Executive of the Association to issue the following statement:

Prior to 1982 prison officers enjoyed the constitutional right to belong to a trade union of their choice, and as a matter of fact there was a prison officers division of the National Union of Public Workers. In that year an amendment to the Prisons Act provided for the establishment of the Prison Officers Association.

As a result of that amendment, prison officers lost their constitutionally guaranteed right to belong to a trade union. Section 24A of the Prison Act states:

24A.(1) There shall be established an Association to be known as “the Prison Officers Association”.

(2) The purpose of the Association is to enable prison officers to bring to the attention of the Superintendent, the Board and the Minister matters affecting the welfare and efficiency of prison officers.

(3) No representation may be made by the Prison Officers Association in relation to any question of discipline, promotion, transfer, posting, leave or other matter that affects an individual member of the Association.

(4) The Prison Officers Association shall be independent of, and unassociated with, any association outside the Service, other than similar Associations in and for Anguilla, Antigua, Belize, Dominica, Grenada, Guyana, Jamaica, Montserrat, Saint Christopher and Nevis, Saint Lucia, Saint Vincent or Trinidad and Tobago.

Further, at section 24C the amendment goes on to prohibit a prison officer from becoming a member of unauthorised associations. Interestingly, among other things, subsection (5) defines “unauthorised associations” to mean a trade union as defined in section 2 of the Trade Unions Act.

Notwithstanding this prohibition, since 1992 the Government of Barbados has allowed the Association to become a member of the Congress of Trade Unions and Staff Associations of Barbados (CTUSAB), and by so doing, the Government has allowed prison officers to freely associate with trade unions and become part of the much vaunted Social Partnership. In addition, management of the prison has facilitated the Association’s membership in CTUSAB by granting officers time off to attend trade union activity.

The President of the Association Mr. Trevor Browne, even though maintaining his innocence, has been charged with essentially carrying out the functions normally associated with a trade union leader.

In order to protect its members from any further criminal charges arising from its association with trade unions or anything that is likely to be interpreted as trade union activity, the Prison Officers Association has terminated its membership in CTUSAB, until such time as the 1982 amendments to the Prisons Act are repealed by Parliament or struck down by the High Court.

  2. It took 4 months after they moved the court for us to hear that they have NOT started work on the roof yet..that was 2 months ago…but both the Canewood and Manor Lodge locations HAVE ROOFS…so why are people NOT GETTING COURT DATES… to get their cases finished…

  6. GP..they are the most wicked people…they have no functioning court due to their own decades of criminality and incompetence…and are ALL GOING OUT OF THEIR WAY…TO MAKE SURE THE COURT NEVER FUNCTIONS AGAIN…

    Because the Whtepark location needs a roof does not mean that ALL court function should STOP…BUT THAT IS WHAT IS HAPPENING….the Canewood location is a brand new building with a new roof…and though small and stifling, so is the Manor Lodge location…where am sure they are paying a large amount in rent every month with taxpayer’s money …and yet…ya cannot get a court date…

A competent government would have made better arrangements and made absolutely sure that there was continuity in the court process..but no, watch and see a year from now we will be hearing SHITE about backlogs at the supreme court, same crap we heard before they imported CJ Marston Gibson…same shite we are heard 10 YEARS AFTER importing Gibson….the jokers in parliament live to violate people’s human rights…and they should not be allowed to get away with this…WITHOUT EXPOSURE..

John…inconsequential. …the backlog is in the thousands, many, many thousands and from MANY, MANY YEARS AGO …one or two cases a month is not cases, I doubt 10 cases has been heard AND COMPLETED since SEPTEMBER …this is December, hundreds of cases were adjourned,…that is why people are complaining, cases that should have been COMPLETED OVER A YEAR AGO…the Claimants CANNOT GET ANY DATES….the Judges are NOT DOING THEIR JOBS…effectively…or no one would be complaining. .

    This is information I know for a FACT…not hearsay.

    It would not take a geniuses to make a decision of self interest one which would include seeking higher ground for survival to the point of leaving the island
    For sure a person on low income having to pay personnel debt and govt debt cannot be easy
    The rationale behind the economics of such a policy is mind blowing to say the least and illogical in its beginnings

    David there is no need to mention anything about materials for a roof, Abigail knows that. The Salemite is more interested in talking igrunce about persons deliberately stalling the “functioning” of the Court. The last time I checked, the Supreme Court consisted of the High and Court of Appeal. A browse of the court’s website shows a hearing list for high court and court of appeal cases up to last month. Are they publishing Hearing Lists for publishing sake? Everyone knows the building on Whitepark Road is closed for repairs and I hope they know a building does not define whether the court is functioning.


  26. The blogmaster is listening out for an update from the AG about the plan to retire old cases read greater than 10 years. All agree the backlog cannot be cleared based on current resources available.

    So why are cases that should have been COMPLETED 2 YEARS AGO and less…STILL HAVE NO JUDGES descisions….do they need a completed roof…to CLOSE CASES..

    The resources are not the problem….THE CORRUPTION BETWEEN JUDGES AND LAWYERS AND INSURANCE COMPANIES. ..and OTHERS….that is the PROBLEM…, that is why cases are not being COMPLETED…

    Einstein explain this BASIC rule many years ago.

    If a Jackass was UNABLE to complete a course at any time …for twenty years,
    it should be OBVIOUS that you need thoroughbred for that course,
    …and it should be even MORE obvious that you cannot expect the jackasses to come up with a solution
    – given their limited brass bowl intellect.

    A thoroughbred will then go on to make that SAME course look like cake….
    …and BEG for a real challenge to avert boredom…

    Barbados is a place where Jackasses are attempting to perform on courses that are set for thoroughbred horses….

    We have had this discussion many times over on BU. We have several thousand cases where files have disappeared or gone missing, judges have retired, witnesses can’t be found etc. All of this in a court that statements are taken by long hand etc. we have to implement a short term plan to overlap with a medium and long term.

    Are you aware caseload backlogs is a problem in many regional jurisdictions?

    However such horses require proper conditions in order to perform.

    Wise owners select good stock and then provide the conditions, constraints, rewards and recognition to get the desired results. Even then, when results are not up to expectations, CHANGES are made – but the FOCUS is on results.

    Where does the Credit Unions find the race horses to continue to succeed ….and in the same shiite environment where EVERYTHING ELSE seem to be failing?
    You won’t find more ‘ordinary’ persons anywhere….
    But you also won’t find such a COMMUNITY-CENTRIC SYSTEM anywhere else….
    With appropriate PRINCIPLES, guidelines and CHECKS AND BALANCES.

    Look up the meaning of ‘functioning’ …and then look up ‘or not’….

    The court is worth shiite.

    Publishing a shiite schedule and then adjourning the cases for six months is NOT functioning.
    Accumulating an ever ACCELERATING load of unresolved cases is NOT functioning.
    Putting on a pappy show by morons in tails …. is NOT functioning.
    Wasting people’s valuable time sitting around Manor Lodge… IS NOT ‘functioning’…

    If you were to allow your natural HONESTY to peep over your yardfowl blinkers, you would agree 100% with Bushie….

Either way…there are cases lingering in the supreme court that should have been completed a year…2 years…3 years….15 YEARS AGO…if the scum in the attorney generals’ office, in the bar association, sitting on the bench were not all taking some level of BRIBES to keep these cases UNMOVING in the supreme Court…INDEFINITLEY

    Not a yardfowl, supreme or otherwise…can change that FACT…

    I duncey, but I always thought functioning meant–working/operating. For example yours and the Salemite’s brains are functioning; the degree of functionality, however, is questionable. As usual when cornered you resort to name calling and semantics. Only yesterday the Salemite was blistering the PM for only focusing on the use of marijuana in the context of tourism (her interpretation), now today look at the Nation. I repeat–clueless…but then again she vehemently argued that Roleric Hinds was the duly elected MP for St.Thomas.
