This week I planned to write about the much vaunted Public Service Act (PSA) that has failed miserably to live up to its billing about improving the operations of the Public Service. But before I do, please allow me to take a detour to address something that has affected me personally.

On Tuesday, December 5, 2017 I was at home relaxing and my phones started to ring off the hook. Several callers alerted me to a debate that was going on in the House of Assembly, where some reference was made about me. Even though my name was not mentioned by the particular member of parliament, he was so explicit that several persons were able to identify me.

I will not go into specifics, other than to say that the remarks were untrue. But I will say that persons, speaking from the floor of the House of Assembly, should not use that forum to falsely attribute things to private citizens, who do not have the right to reply before the same audience.

In accordance with the Parliament (Privileges, Immunities and Powers) Act, members of parliament cannot be sued for anything they say in the House. That privilege should not be abused. Enough said for now.

On December 31, 2007 the Public Service Act came into force. Its long title states:

An Act to revise and consolidate the law relating to the administration of the public service for the purpose of achieving greater efficiency and effectiveness in the management of that service and for matters related thereto.

I make bold to say, without fear of sensible contradiction, that the lofty goals of “achieving greater efficiency and effectiveness” have not been even slightly achieved. The Public Service is far worse than it was prior to these “legislated improvements”.

Persons who are unfamiliar with the actual legislation would most likely conclude that it only deals with appointments and promotions, since that’s all the public hears about. In that regard, it has ushered in a regime that has thwarted the legitimate expectations of promotions and appointments for deserving officers, in preference for relatives of senior public officers and politically aligned persons.

The 1978 Public Service Regulations, that were largely replaced by the PSA, were far superior to what currently obtains. Under the old regulations, an officer who was superseded had an avenue to question and reverse his supersession. No such provisions were made under the PSA. That is why so many public officers have to resort to the courts, which unfortunately move like molasses flowing uphill.

The PSA is probably the worst piece of legislation that I have encountered in the 37 years that I have been involved in the Public Service, first as an employee and then as a workers’ representative. However, I do not want to give the impression that there are no positive aspects of the legislation. I will deal with one now and over time others will be highlighted in subsequent columns.

Paragraphs 11 and 12 if the Code of Conduct and Ethics, the Second Schedule to the PSA, originally gave me hope that the the authorities were finally going to do something about the endemic corruption and other misbehaviour among many senior public officers.

Subparagraph 11.(1) instructs a public officer to report if he is being required to act in a way that is, among other things: illegal; improper; or unethical. Similarly, subparagraph 11.(2) requires an officer to report any evidence of criminal or unlawful activities by others. The officer shall report such activities to his head of department, and where the head of department is involved, the report should be made to the Head of the Public Service.

Also, it is a major offence that merits dismissal if an officer fails to report this criminal activity. And any such reports shall be done in accordance with the procedure laid down in the appropriate guidelines or rules of conduct for the officer’s ministry or department. This all sounds so nice but after 10 years no guidelines have been published, and as far as I am aware, no drafts have ever been circulated.

This alone demonstrates how serious Government is about stamping out corruption in the Public Service.

    How are any of the corrupt civil servants going to report anuthing if they are ALL corrupt and taking bribes and benefitting significantly through huge offshire bank accounts for decades, remember Straughn, big mansions, multiple overly priced and expensive vehicles, when some of the heads of the civil service are also known to take bribes and their bosses the ministers are all taking bribes….how will that work.

    The legislation is useless, you need legislation and procedures that are on steroids, with teeth.

    The 1978 lala legislations do not apply to today’s, tricks, scams and cons, it’s nonsense…in 2017.

    I beg to differ. The vast majority of public officers have no way to be corrupt. However, there is a significant minority that practice their thieving ways with impunity.

    The reason why officers refuse to report wrongdoing is that they fear the backlash. I remember that a court marshal, who was acting as a supervisor for three years, reported the current Chief Marshal for perjuring himself by swearing an affidavit and returning it to the court.

    The Chief Marshal recalled a warrant of arrest for a man from the Bay Land and swore that the man could not be found. He did not realise that there was also a summons for the same man to come to court. The marshal for that district duly served the man and he turned up for court. The man was seen in the court yard by another marshal, who recalled seeing a warrant for the guy’s arrest. This alert marshal went into the office, retrieved the warrant, executed it and took the guy to Dodds Prison.

    The acting supervisor, a man named Wiseman, who reported the perjury was taken down and another marshal was promoted to act in his stead.

    It is ironic that the new acting supervisor was in the process of paying back, by instalments, money that he has stolen. Apparently, he had collected court fines that he put to his own use, and for that he was put to act and the acting allowance was apparently used to pay off the money he had stolen.

    Oh, by the way, I have several copies of the warrant with the perjured affidavit endorsed on it.

    Caswell…we know it`s a minority that are really, really dirty and the cleaner majority civil servants cannot fight back with the current weak legislation in place.

    ..however, its that minority staining the whole civil service and have been for decades..cant cherry pick in that scenario, its been too destructive.

    i have seen lawyers coach their witnesses to lie to the court on the witness stand, they perjure themselves without consequences, even though the judges knew they were lying, i was stunned…the judges seem helpless to lock up perjurers and lawyers who lie to the court on a daily basis.

    ..i have seen lawyers lie to judges to their faces to delay cases, without consequences…lying and perjury are acceptable practices in the court system..

    the structure of procedures and practices at the supreme court are as fundamentally weak as are civil service legislation, they serve no useful purposes.

    you have a weak useless attorney general and office..and after 9 years, it`s fair to say you have an even weaker and equally useless Chief Justice as Amused, bless him, always opined.

    the structures in the system are destructively weak and degraded…so it`s safe to say those weak structures are in need of a remodelling or you will still be on BU in another decade pointing out even more degraded weaknesses.

    Which one is it?

    I suspect that the fear factor plays a large part, those at the bottom of the food chain are frightened for their skins.

    I am not saying those at the bottom of the food chain won’t behave any differently if given the chance do the same thing.

    If that’s right how do we fix the problem?

    It is like the sexual harassment issue in the US.

    Somebody needs to step up to the plate and the whole mess unravels.

    At the risk of attracting howls of protest I suggest Trump has empowered a lot of people in the US to step up to the plate.

    He has done it by example.

    We just need a Trump here if that logic is right!!

    … an alternative would be simply to return to core values which is really all Trump is saying!!

    People need a leader to follow.

    Bushman…as long as Caswell understands that all the structures in the Barbados system started out weak and continued to be weakened decade after decade by corruption in the cìvil service, in the supreme court, in the government, in parliament….it will be made abundantly clear that a paradigm shift has to take place….along with exposure of every one of the corrupt criminals involved..to save even a small portion of the island’s integrity…which is currently in tatters worldwide because of all the corruption.

    In 1971 I applied to join the public service. I have not had a response as yet. I suspect that is because I did not/do not have a godfather. I suspect that the public service is exactly the way it has always been.

    9 years ago I typed on BU that the level of civil service ineptitude and lack of facilitation was at an all-time high.

    It has gotten worse.

    Barbados is at an economic standstill due to lack of ministerial micro-management and civil service facilitation.

    You cannot push a rope. It will take strong ministerial management by the next gov’t to turn things around from the top.

    Everywhere else in the world promotion brings harder work, longer hours, more responsibility. In Barbados it is the opposite: promotion brings poor time-keeping, less effort and terrible example to those below.

    The civil service is the employer of last resort in this country, welfare for political lackies.

    Unfortunately, due to the relentless growth of bureaucracy in Bim, it has become impossible to work around the problem.

    Barbados wasn’t built by the civil service, it was built despite the civil service. The only things that will move us forward is a massive re-organisation and marginalisation.

    I think that your longstanding frustration has led you to the point where you sanity is being affected.

    Ministers are not intended nor should they manage anything. They set policy and allow the professionals to implement. Contrary to what you have posited, it is ministerial micro-management that has led to the rapid decline of the Public Service.

    Contrary to section 94 of the Constitution, politicians get involved in recruitment of public officers. That is mostly responsible for incompetent political lackeys being promoted to management position in the service. Ministers install a lot of stupid managers who then rely on the same ministers, who influenced their appointments, for guidance.

    Ironically, just recently a Minister was given a national award for the fiasco that was Carifesta. He apparently managed the process. That is a job for the Public Services. He got an award for doing someone else’s job and doing it badly.

    Your above comments are true and I’m in agreement 100%, especially your point that these dishonest politicians “pass favours on to friends and family…..”

    This inept DLP administration has been abusing the system by rewarding DLP sympathizers with national honours.

    Perhaps you could tell me what Anthony Bryan has done that is so spectacular or developed Barbados in some special way that merits THREE national honours, which was previously unheard of in this island?

    Bryan was awarded:

    (1) Gold Crown of Merit

    (2) Champion of Honour of Barbados (CHB) and recently

    (3) Knight of St. Andrew

    The only thing I could think of at this moment is, he has been rewarded because the Advocate Newspaper spreads the gospel according to the DLP.

Unfortunately, politicians have intervened and neutered the senior public officers. You should be asking for the removal and replacement of the incompetent senior public officers. However, the replacements should not be manoeuvred into place by politicians.

    It IS the job of the minister to ensure that Permanent secretaries are efficient and effective.
    They do this by monitoring performance RESULTS, and by hiring competent persons.

    You always looking for some complicated way of solving simple problems….. just like you resist a Credit Union owned bank by arguing that it SHOULD NOT be needed – because Credit Unions SHOULD be able to do everything a bank can do now…

    If the Head of the Public Service investigates and his findings support the minister’s position, the matter should then be reported to the Public Service Commission. The problem comes because the permanent secretaries owe their appointments to the Prime Minister and so too does the minister. One big happy family that can’t tell each other when to come back.

    Caswell I understand your point completely; please try to understand mine.

    99% of successful business people in this country started at the bottom. The Law of Natural Selection cannot be defeated; we either evolve by learning our craft or are felled by competition and forgotten forever.

    We bring behind us our successors; those who fail are groomed out, many of the best take off on their own when opportunity arises but many stay within the organisation which has groomed them specifically.

    The exact same succession situation exists in the public sector and statutory corporations except there are no lions to eat the slowest gazelles. In fact, the fast gazelles expose themselves to the greatest danger in the Bajan public sector by leaving the pack behind. They are the first to leave.

    The problem is not the PS, the civil service attitude is cultural.

    My point simply is this: only someone with a whip is going to get the cane cart back on the track and the oxen moving again. If it can’t be accomplishes by a strong leader we have no chance, regardless of the theoretical processes that exist.

    When applying for a passport, I must submit photographs signed by a Justice of the Peace, identification card and birth certificate. Then I have to wait for about two weeks before the application is processed and receive the passport.

    However, if I know an Immigration Officer or give them a small fee, this process is circumvented and I could receive my passport the same day I applied for it.

    Likewise, if I know or pay someone working in:

    NIS or BRA, I could receive my sickness benefit or income tax refund within a week;

    Customs – get taxes waived or bring in any amount of alcohol, clothing, electronic equipment etc, through the air or sea ports………free of duties;

    Police Service – have a case or report “thrown out;”

    Licensing Authority – I could get my driver’s license without going through the ordinary procedures.

    The High Court of Barbados recently issued a Summons with Warning to PS, MOF to force appearance before said Court to force MOF’s compliance with a Court Order issued six months prior in a civil matter.

    This was right after the attorney from the AG explained to said Court that he would like to fire his client but could not.

    Nor could he charge his client for wasting his and court time.

    Now tell me Caswell, if the highest court in the land and the lawyers who represent gov’t can’t get civil servants to do their jobs, what hope in Hell do the rest of us have?

    These rat dens need to be smoked out.

Here is a question to support what the others are saying- why have the credit unions through the league not been able to persuade government to pass the necessary legislation to permit deposit insurance? What is the problem?

    Any judge, who can’t get a public officer to comply with an order of the court, is playing the donkey. Failure to comply with an order of the court is contempt of court which is punishable by prison time. You should ask the judge why has he/she not committed the offender to prison? An unemployed man who cannot pay his child support is sent to prison for 42 days for contempt. Why is this public officer being treated as though he/she is above the law?

    If a public officer is jailed for contempt, the magistrate or judge is required to report the matter to the Public Service Commission. That officer can then be dismissed from the Public Service.

    All you are talking about is a failure to follow the law on the part of the Government and courts.

    There is no functioning supreme court system on the island, we cannot say that enough, government cannit even get a 20 year injunction lifted through the supreme court, an injunction is routine to have removed. ..

    …..a chief justice that is a political appointment is no real chief justice and cannot change anythjng, judges who are politically appointed and not elected….are powerless…

    We have a civil service of do-nothingers, path of least resistance, only two more hours after lunch until we can leave work at 3pm, underachieving, un-enforcers.

    We can start with the COMPULSIVE LIAR………. the bombastic Christopher “King Liar” Sinckler.

    FIRSTLY, recall when the talk of the “eager 11” first surfaced. On December 12, 2011, Sinckler was seen on CBC TV8, DENYING any KNOWLEDGE of an attempt to replace Prime Minister Stuart. “I’m not dealing with any of that. I have no comment on that; I KNOW NOTHING ABOUT THAT other than what I read in the Press,” he said.

    However, in an interview reported in the December 18, 2011 edition of the Sunday Sun, Sinckler admitted that he and ten of his Government colleagues were seeking an “urgent audience” with Prime Minister Freundel Stuart to discuss matters of “grave” concern and to chart a path forward for the retention of the Democratic Labour Party (DLP) in Government.

    SECONDLY, I remember Sinckler informing Barbadians 2 members of RBPF told him they were conducting investigations after overhearing 2 men planning to assassinate him. What happened to that investigation?

    THIRDLY, Sinckler “CATEGORICALLY DENIED” the allegation by Mottley that government was about to increase the stipends for the members of the NIS Board.

    It was only after Mottley displayed a copy of a cabinet document, at a public meeting, to substantiate her claim, Sinckler subsequently called VOB’s “Brass Tacks” to admit it was true and offered an apology to her.

    It is by FAR more challenging to identify something that this particular shiitehound EVER said …that turned out to be true….

    The man seems to have the same aversion to speaking the truth as he has to decimals….?

    I took up your challenge…………. but I’m now “out of pocket” because the headache ensued therefrom required me to purchase nuff, nuff Panadols.

    However, I managed to identify one “phrase” he has repeatedly mentioned that is yet to be proven either true or false…………..

    …………….. “the economy is turning the corner and there is light at the end of the tunnel.”
