There is no such thing as “American Exceptionalism”! And therefore, the President and Government of the United States of America (USA) are just as subject to the rules of International Law as are the President and Government of any other country.

Thus, when– on Friday the 11th of August 2017 — President Donald Trump of the USA threatened a unilateral military strike against the sovereign and independent Bolivarian Republic of Venezuela he was breaching a rule of International Law that is so fundamental that it is enshrined in Article 2 of the United Nations (UN) Charter.

Article 2 (4) of the UN Charter stipulates that “all Members (of the UN) shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner inconsistent with the Purposes of the United Nations.”

But this was not the first or only time that President Trump and his Administration had committed a flagrant breach of the said Article 2 (4) of the UN Charter !

Indeed, ever since taking up the office of President of the USA in January of 2017, Mr. Trump has attacked the Bolivarian Republic of Venezuela on no less than four occasions by issuing Executive Orders and inflicting punitive and damaging sanctions against the Government and people of that sovereign, politically independent nation.

President Trump also went on the public record on Tuesday the 8th of August 2017 threatening the Government and people of the Democratic Peoples Republic of Korea (North Korea) with “fire and fury like the world has never seen” if — according to him — the Government of North Korea makes “any more threats to the United States”. This –it is clear — is a threat of a nuclear conflagration that will be much more horrific than the “atomic” decimation that the USA inflicted on the cities of Hiroshima and Nagasaki in 1945 !

And, as if to further emphasize his utter contempt for the precepts of International Law, Mr. Trump used the podium of the General Assembly of the UN on Tuesday the 19th of September 2017 to issue a further threat to “totally destroy North Korea”, and to publicly parade his arrogant determination to defy the many U N resolutions that have denounced the USA’s illegal and genocidal blockade of the Republic of Cuba and demanded its termination.

In light of the fact that the USA has proven itself to be, perhaps, the most aggressive and warlike nation in the history of the World — with a record of having initiated or participated in well in excess of two hundred major military assaults or wars against other sovereign, independent countries during the 241 years of its existence as an independent state–the international community of nations would be well advised to take President Trump’s illegal threats and attacks very seriously.

It is against this background therefore that we, the Members of the Caribbean Chapter of the International Network In Defense of Humanity, would like to remind all member states of the United Nations of their Constitutional power to bring the issue of President Trump and his flagrant and dangerous breaches of International Law before the UN General Assembly for collective discussion and for the prescribing of an appropriate response by the World community.

Article 11 (2) of the UN Charter establishes that “the General Assembly (of the UN) may discuss any questions relating to the maintenance of international peace and security brought before it by any Member of the United Nations…..and……may make recommendations with regard to any such questions to the State or States concerned or to the Security Council or to both….”

Furthermore, Article 20 of the Charter provides that “special sessions (of the General Assembly) shall be convoked by the Secretary-General at the request of……. a majority of the Members of the United Nations.”

In light of the foregoing, we — the Members of the Caribbean Chapter of the International Network In Defense of Humanity now hereby:-

(1) CALL upon the responsible and peace-loving Member States of the United Nations to join together in a collective effort to bring the issue of President Trump and his flagrant breaches of Article 2 of the UN Charter before the General Assembly of the United Nations ; and

(2) REQUEST that all responsible and peace-loving members of the human family support this CALL by:-

(a) attaching their signature, name and address to this CALL ; and

(b) forwarding this CALL to the Head of Government and Minister of Foreign Affairs of their country either via e-mail or by printing and sending a hard copy.

    Even Russian President Vladimir Putin skipped Trump’s big speech. Other notable names notin attendance included Chinese President Xi Jinping, Germany’s Angela Merkel, England’s Theresa May and Mexico’s Enrique Peña Nieto.

    Trump has attacked all of the world leaders mentioned above in one way or another. Donald once demanded that Germany pay its fair share into NATO. He’s ridiculed China for the way the government handles North Korea.”

    CL financial FORMER executive chairman: Lawrence Duprey

    FORMER executive chairman of CL Financial Lawrence Duprey was ordered by a Florida judge in July to pay more than US$60 million to British American Insurance Company (BAICO) in damages in relation to the TT$1.9 billion Green Island project in Osceola County, Florida.
    The insurance company had taken Duprey and one of its former executives, chairman Brian Branker to court claiming a breach of fiduciary duties on their part by allowing it to pump billions of dollars into the real estate transaction which was executed by BAICO and British American Isle of Venice in January 2008 for the purchase price of US$295 million.
    Duprey and Branker were ordered by Judge Erik P Kimball of the United States Bankruptcy Court in the South District of Florida on July 31 to each pay BAICO US$61,318,225, a total of US$122,636,450.

    Court documents stated that the companies had pursued the land transaction that resulted in a loss allegedly exceeding $100 million.

    This loss was a primary cause of the insolvency of the companies and their multi-national insolvency proceedings. It went on to state that Duprey was provided with due process in that he was personally served with process at the start of the case in January 2012 and the next month, he, through counsel, moved the court to dismiss the original complaint for lack of subject matter jurisdiction. However, this application was denied by the court in February 2013.
    The order denying the motion to dismiss was served on attorneys for Duprey on March 2 that year. He was given 14 days within which to file an answer, but failed to do so.
    In August of that year, Duprey’s attorney withdrew from the case.

    Nothing done with case Between then and 2015, the court had granted permission for the companies to amend their claim and these amended complaints were sent to Duprey’s residence in Ft Lauderdale, Florida.

    “In the ensuing two years, Mr Duprey did nothing at all with regard to this case. In contrast, during that time the companies were quite active. With defaults in hand against Mr Duprey and certain other parties allegedly central to the failed real estate transaction, the companies negotiated with a number of other defendants and entered into settlements for amounts far below the total damages allegedly suffered by the companies.

    “Had the companies believed that they would have to go to trial against Mr Duprey, the marginal cost of going to trial against the settling defendants would have been low, significantly reducing the companies’ incentive to settle with them. During this time the companies participated in extensive discovery with other defendants.

    “But, because Mr Duprey had been defaulted, the companies served no discovery on Mr Duprey relating to his involvement in the subject real estate transaction,” court documents stated.
    The documents further stated that in October 2015, having finalised negotiations with other defendants and finding themselves ready to conclude this case, the companies properly and timely filed the Motion for Judgment against Duprey and Branker.
    Three weeks later, more than two years after his prior counsel was permitted to withdraw in 2013, replacement counsel for Duprey filed notices of appearance.

    Duprey then filed a response to the Motion for Judgment and also filed the Motion to Vacate.
    He argued that the Court should either dismiss the amended complaint or vacate the clerk’s default because the companies allegedly failed to properly serve him with the amended summons. He had also argued that his inactivity between 2013 and 2015 was not willful because he was 81 years old and his counsel withdrew from this case, and thus he did not realise he had an obligation to respond to the original complaint after denial of his motion to dismiss or to the amended complaint. Liable for damages However, that Motion to Vacate was also eventually denied and the companies’ Motion for Default Judgment granted.

    But the court said even though the amended complaint well pleaded with regard to the claims against Duprey and Branker, it stated that the amended complaint did not present a specific request for damages.

    The court said it was appropriate to require the companies to present evidence on the issue of damages and to permit Duprey and Branker to contest that evidence.
    In the end, the court found that the Motion for Judgment should be granted in part, ruling that Duprey and Branker shall be held liable for damages.

    The Express was unable to confirm yesterday if the court’s ruling had been appealed.

Hants, I am not sure if you are suggesting that Canadian companies might as well return the offshore investment to Canada rather than to the USA, but we will have to wait and see what a gross 15% corporate tax rate in the US would produce in terms of an effective rate after deductions as well.

  44. Calif. Lady Moves to Red State, Suddenly Sends Unexpected Message to Lib Friends Back Home

    Flyover country. Bible belt. Middle America. Coastal elites in liberal cities have all sorts of terms for “red states,” but they all seem to convey one message: Conservative areas of the country are somehow backward and should be avoided.

    That’s the impression one California writer had about America’s heartland. Leah Singer never imagined that she would end up in Trump Country… but when she moved to Indiana not long ago, her entire perception changed.

    In an editorial piece published last weekend in the Indianapolis Star, the author sent a clear message to liberal friends back in California and throughout the country: You might be wrong about “red states.”

    As a “California girl,” the writer explained that the left-leaning west coast sees itself as a bastion of “diversity,” but Singer hinted that it was less of a paradise for anybody who didn’t parrot the liberal talking points.

    “I was raised in California, where we like to believe diversity is applauded and opportunities abound,” she explained. “In many ways, California’s blue state bubble can be a very safe place to live if you subscribe to the popular liberal politics.”

    In other words, it was diverse only if you thought and talked the same as everyone else, which kind of defeats the point. Regardless, Singer was a bit apprehensive about starting her new life in a conservative region.

    “Over and over, I was questioned about why I would ever leave the Golden State for a ‘flyover’ red state. This phrase alone troubled me, and the implied perception that one flies over the Midwest just to get to their East or West coast home,” she stated.

    Like sheltered people naively asking about a faraway land they’ve only vaguely heard about, the writer’s west coast friends had a lot of curiosity about how things were in America’s heartland.

    “As I settled into life in the Midwest, I heard the same assumptive questions: ‘Did everyone you know vote for Donald Trump?’ ‘Are there African-American, Jewish, Asian, LGBTQ people in Indiana?’ ‘Do people make fun of you for listening to National Public Radio?’” Singer recalled.

    The coastal transplant quickly realized that her past impressions of conservative America were nowhere near the reality.

    “As I got to know my new Midwest home, I realize how living in a bubble and subscribing to the Middle America stereotypes is truly damaging to this country,” she explained.

    “Never does one ask how the Indiana public schools provide many opportunities that have been cut from California’s public schools because of one budget crisis after another,” Singer continued.

    “Never does one ask about the low cost of living that is allowing us to pay off the mountain of debt we accrued in California. And never does one ask about my fellow community members, who are running successful businesses, enriching the city’s arts and making a difference for the local environment.”

    She noticed something that “enlightened” coastal liberals often ignore: Places such as California may not be as truly diverse as they pretend to be.

    “Southern California is diverse racially and religiously; it really is not with respect to class or working poor,” the writer revealed.

    “This is especially the case in San Diego County, where it’s becoming more difficult for middle-class families to own a home or afford rent, with 41% of homeowners and 57% of renters spending 30% or more of income on housing, all while incomes stay stagnant, according to the San Diego Regional Chamber of Commerce.”

    In simple terms, many places in liberal enclaves have become so expensive to live that economic diversity is a thing of the past. It’s a bit like pretending that a gated community where everyone is a doctor or lawyer and drives a BMW is “diverse” — different racial boxes may be checked but it’s all a bit boring.

    In the end, Singer’s positive experience with the midwest helped her realize that many coastal elites purposely bury their heads in the sand when it comes to real diversity within the United States.

    “(H)ow many of these people travel within their own country to get to know the ‘other?’ Why travel the globe, but not make an effort to get to know your Midwest neighbor?” the author asked.

    “Living in Indiana, I now have an understanding of America that I did not before. I wish more people living outside the middle took the time to get to know the others living a few states away. I did, and I am a better person because of it,” she concluded.

    She may not completely realize it, but Singer has stumbled upon an important fact. Liberal obsession with diversity often shuns true multiculturalism — a variety of opinions, thoughts and political stances — and instead focuses on the “feel good” categorization of irrelevant traits like skin color.

    In many of the most important ways, conservative areas of the country are advancing while liberal neighborhoods face major problems.

    Thankfully, people like Singer are having their eyes opened once they actually escape their bubble… and they’re realizing what conservatives have known for decades: Small town America might be on to something after all.

    It is incompetent regulation. All they have to do is form a ‘good’ Clico and a ‘bad’ Clico. The good Clico will continue the business, meeting its obligations to policyholder s, while the bad Clico will wind down the assets.
    It is not rocket science. We have been having it since 2008. I have said before, incompetence is our big problem, a bigger one than corruption.
