As promised BU produces the letter in its original form which the BSTU sent to the Chief Education Officer arising from a ‘secret meeting’ under his chairmanship. It does not matter how anyone tries to interpret the letter, to any competent person (counsel), the threat and inference is crystal clear. If one compares what is stated in the last paragraph of the letter attached to what was reported in the Nation today, “BSTU first vice-president Erskine Padmore said again yesterday that his members would resume work as scheduled pending the findings of the Waterman Commission Of Inquiry, set up to look into affairs at The Alexandra School.” The BU family can draw one sensible conclusion.

Can anyone explain anyway why the Chief Education Officer Laurie King held a secret meeting with the BSTU immediately following the COI – at a cost of $600,000.00 – which was expressly established to to make the AX Mess a transparent affair? Let us forget about the decision by Commissioner Waterman to hold the COI summations of counsel in camera.

BU raises AGAIN the question of conflict of interest by Keith Simmons, a member of the Public Service Commission – employer of those employed at Alexandra School – and also the chairman of the management committee of Alexandra School. When it was suggested to him by counsel that he was in conflict of interest in holding both those posts, he replied that he was not and if a conflict arose, he would recuse himself from one or the other. Why can’t he see his roles as being improper and that by holding both posts and being privy to confidential information from both, he is in conflict of interest? What manner of lawyer is entitled to wear silk in Barbados again?

The other issue about the Commission of Inquiry which bears close study is to examine its remit, i.e. to investigate matters that occurred in 2011 (a) the refusal of Amaida Greaves to teach for a long period of time; (b) the letter from the Principal complaining of this; and (c) the conduct of the Principal at Speech Day. For some reason best known to Commissioner Waterman the CIO directed itself to investigate a matter since 2002 by introducing a document (transcript) which is highly suspect based on information posted by BU.

BU ask Commissioner Waterman AGAIN why has the COI not produced the transcripts for the last 7 days of the hearing, which covers the matter of interest to Bajans? The matter about which our Fourth Estate went dark. The matter which raises the occurrence of perjury.

I am told by a most reliable source that the NUPW is not at all happy and there is even the suggestion that meetings with counsel. I can only assume that erice has be advised that there is a rumbling in the jungle and has bee assigned to be part of the preemptive strike force.

    I’m amazed that there are “secret meetings” and veiled threat letters when all fo Barbados undestands that this entire matter legally and statutorily lies with Wateman and the Commission. This attempt to short circuit the process either smacks of

    b) zero faith in the MOE and the COI
    c) zero original intention of an objective commission and findings or

    This blog “Ministry of Education Summons BSTU To Hastily Arranged Meeting Which Provoked ‘The Letter’” and the hastily published blog entitled “UPDATE On Alexandra School Matter – Strike Action LOOMS!” demonstrate what happens when special agendas take over.

    The matters raised in the letter published under the BSTU’s letterhead bears no relationship or resemblance to the alleged report contained in the “Strike Action LOOMS!” blog.

    This undue haste to condemn the BSTU on the basis of this “report” makes it hard to conclude other than that there is an agenda to discredit the union.

    The only crediblity which is being damaged by the publication of this “information” in the manner is which it was done is that of Barbados Underground, which has argued so fervently that the blogs should be respected for their critical role in bringing matters to the attention of th public.

    Sometimes it is appropriate to wait a while, rather than leaping to respond to each piece of gossip which is whispered quietly in our ears.

    Authority should go hand in hand with responsibility.

    As a matter of fact, Mr. Broomes is on record as having stated to the COI that he does not read correspondence which comes from the BSTU.

    Pray tell me, how is it intended that he will manage the members of staff who are represented by this union? So many of us are required by the responsibilities of our job to read correspondence from, speak to and meet with persons we consider to be vexations to our soul. And yet we cope.

    I believe that is called mature management.

    Anything less is a recipe for disaster.

    The BSTU letter dated 02 Sep 2012 makes no threat of strike action. Why jump to conclusions?

    The letter speaks to the proposal for the establishment of a Committee of Management and seeks to be informed of the boundaries and legal basis for this committee. The questions asked appeared reasonable to me.

    In the final paragraph, the BSTU offers the suggestion for Mr. Broomes to be sent on leave – either a term’s leave or special leave. There is no threat of strike action contained in what I see written.

    Let us not jump the gun.

    In answer to the question which asked whether “they”, presumably the BSTU teachers at the Alexandra School, will commit to working with him professionally until the process has taken its course, one could also enquire whether Mr. Broomes will commit to recognizing the union and affording its leaders and members the respect which is due.

    And we could go on and on and on.

    Perhaps we could wait for the process to run its course before we jump to conclusions and make baseless accusations.

    Let us wait a while and until then, temper the comments.

    Well, as I have pointed out, why would he? He has no power to hire or fire. He did not have the power to suspend or discipline the woman Graves for failing to teach for an entire term. Therefore, there is no reason why the BSTU ought to be writing to Broomes and no reason why Broomes ought to waste his time reading their tripe. Therefore, correspondence directed to him by the BSTU is irrelevant and misdirected. Indeed, it can easily be argued that such correspondence is meant by BSTU to try to intimidate Broomes.

    And you want me to tell you how he will manage the staff that are members of the Union? Well that is simple. He sets them work and ensures that they do it in accordance with the terms of his and their contracts. If they fail to do it, he writes a report to the MoE, which may or may not be lost or misplaced by the MoE, except from here on in I am sure that Broomes will be requiring the MoE to sign for receipt of anything he sends them. But to make it simple for you, if I have a business that I am the chief executive and MD of and I hire union people. I also have a supervisor/manager whose job it is to run the day to day operations, such as scheduling etc. Do you think that it would be the correct for the union to address matters pertaining to the employment of its members to me, who alone has the power to hire and fire and negotiate contractual terms, or to the supervisor/manager who has no authority over the terms and conditions of employment of the union members? And do you think that Manager/Supervisor ought to usurp my position by responding to correspondence directed to him/her by the union? Surely THAT would be your recipe for disaster.

  16. Ms Greaves has a case to answer based on the evidence at the COI. Her explanation was not good enough why she withheld her services after week three.

    Many of us say we don’t read the Nation Newspaper meaning we seldom do because of a dissatisfaction.

AMUSED—-iam not part of that team , i am a retired person who stillpays my dues and medicare and has been told by staff and menbers what has been happening around NUPW -how CLARKE and MALONEY cover up for each other and defrauds this organisation of funds —-what was the amount that was repaid in the $6000. phone bill ..tell us how can we be havng a UNION leader committing this fraud , and then will be first to be telling BSTU about following the rules –he has never follow any rules at the NUPW –or NHC –he deliberality used the card when he is paid a travelling allowance – FRAUD by any standard . Balance you was writting alot about the Auditor General report comment on this one . General Secretary and President both frauds —this is not an accusation -this is true .

DAVID–the nupw credit card is for the conduction of union business —-Walter is paid a travelling.entertainment and telephone allowance plus he has a cell phone which the union pays for —-so why should he be using the organisation credit card to put gas in his car —-David next time you will be telling me that its ok for lawyers to take up the clients money and use it .0r the accountants to use the firms money .

    You missed the point. The card can be used as the vehicle to pay overseas expenses and the allowance paid to the card account no? In this case it appears Maloney did not pay the allowance to the card account. This is where the problem was created. Not excusing a delinquent Maloney.

    there would not be a need for maloney to use the card for overseas travel, he could use his credit card and the allowance be paid into his crdit card account for deuction when used. The Executive did not authorise the issuance of a crdit card to maloney, i am told the accountant gave two cresit card to the GS and the GS gave one to Maloney. Why would the Union require two crdit cards.

    if the union was seeking clarification, why was the letter cc to the Chief Personnel Officer? Was the Chief Personnel Officer present at the meeting, and if no, would the cc letter not appear in a vacuum to her.

    One of the basis thing in letter writing, is, if you are using the saluation Dear Mr. King, you would have had to address him before, that is Mr. X KIng, Cjief Education Officer and continue. Did u write that letter, and was it written by a teacher who is tasked with teaching our children? God help us.

    The duties and responsibillities of the Auditor-General are enshrined in the Financial Administration and Audit Act Cap 5 excerpts from which i share sometimes with fellow bloggers to improve their knowledge on the system of governance in Barbados.
    I strongly believe that persons aspiring to and holding leadership positions in Organisations should not abuse the power with which they were entrusted and should endeavor at all times to display exemplary behaviour in the management of the Organisations they lead.
    I would think that they are procedures in the Union’s rules to deal with allegations of fraudulent behaviour.

    David……..Is Ms. Greaves self employed ?

    Am I to believe that a Principal allowed the students to sit in class without the designated teacher for a whole term ?

    The only reason the two of them still have jobs is that Barbados has very complex and convoluted civil service rules and an army of lawyers and politicians who can turn a simple issue into mind boggling complexity yhat results in a Commission of deposits into Lawyers accounts at Taxpayers expense.

  33. @balance. As it is a question, no, I do not believe that Broomes did perjure himself. He was confronted with a slip of paper on which he had scribbled notations back in 2002 and not seen since. He was confronted with an accusation of fraud which, had he committed fraud, I would have expected hm to remember. It is clear to me that Broomes did not commit fraud and had no fraudulent intent and, having acted correctly and the need to communicate with a school in the USA not being necessary any longer, other far more pressing concerns related to his job, took priority in his mind. Therefore, it is a question of recollection. Some years ago, I was giving sworn evidence in a matter that had occurred many years prior. Both my examination and cross-examination were extremely polite with a sincere desire on both sides to get at the truth, rather than to score points. One question from counsel on cross caused me to advise the court that I had misinformed it, due to faulty memory and the lapse of time and that I wanted to go back and correct myself. There was no perjury in this, merely the human condition of faulty memory. This is what happened, in my quite expert view, with Mr Broomes.

    However, the same cannot be said of Neblett Lashley. As counsel for the BSTU was intending to hang a case for fraud against Broomes on her evidence, they must have gone through it with her exhaustively and I sincerely doubt that Hal would fail to thoroughly prep his witnesses, BUT Hal, like any other counsel, is reliant on what the witness tells him and the instructions from his client, BSTU. I refer you to the statement made to the Commission by Mr Vernon Smith QC as posted here on BU. There is clear and undisputable evidence of malice and mala fides and perjury on the parts of Merlene Sealy and Neblett Lashley. They did not mis-speak or have a hazy recollection, THEY LIED! And that is PERJURY!

There are procedures that should be adhered to and guidelines for employees. What I don’t understand is why those who have been hired should refuse to do their jobs. Everyone appears to be paralyzed from the head down. No one wants to mash corns to put things straight. Where the fcuk is MOE? Does the BSTU run the MOE? Does the BSTU have control of the island? Threatening tactics and coercing your bosses will and should get anyone fired. No one owes anyone a JOB.Our Education system is in shambles where are the good men and women to fix this?

  38. There is a concerted effort on these pages to discredit the work of the COI before the findings are released. One can see it in the inflammatory subject titles (unsupported by facts) and the frequent postings by some who have assumed the role of prosecutor ,judge and jury on the blog.

    First it was the raison d’être for the Inquiry, why do we need an inquiry etc. never mind that the whole issue has been a simmering volcano for 10 years. Then it was the costs ($600,000 we are told) which is deemed as too expensive. No one questions what the cost has been for the past 10 years of non productivity, of meetings, of bickering and of student disconnect and under achievement during that period. Can we put a value on emotional costs?

    Then we hear the Commissioner has lost his marbles because of a comment he made during the inquiry, did he suddenly become a stupid or only on assumption of this position? Next we hear that the witnesses have perjured themselves.

    What of the chief witness? He of the “see no evil, hear no evil, speak no evil” and may I add “ do no evil” position. Based on the comments I think he is the reincarnation of George Washington ( I cannot tell a lie), a man who has seemingly left a slew of fractured relationships wherever he has laboured, who has been a shining example of the Peter Principle.

    The age of “my way or the highway” is a relic which we are happy to have left behind, that some still see virtue in this attitude is an indication that we still have a long way to go.

I have been making best efforts to get the transcripts of the COI so that I could send to David to post here on BU. I think that if you read these, you MIGHT come to the view that the COI is itself responsible for the adverse comments on it. For those of us who have had sight of the transcripts, well we have an advantage in not having to rely on reports from the press. The difficulty is that these transcripts are paper, not electronic – at least the ones I have had access to. I have not been able to discover if they are available in electronic.

    HOWEVER, as this was a PUBLIC and, supposedly, TRANSPARENT inquiry, might it not have been responsible and helpful of the Fourth Estate, all of which have online versions, to order and make these transcripts available to all Bajans, instead of inflicting on is their respective highly selective and biased reporting? Indeed, might it not have been a transparent and proper act for the Government itself to have made these transcripts available online to us Bajans who have paid over $600,000 for them and who have paid massive amounts in taxation so as to have our children educated at institutions where these problems arise? So, what is this shit about in camera closing submissions? Do you not, Sargeant, consider that grounds for impugning the COI? Or are you brainwashed into accepting whatever the “officialdom”, whose damned salaries we pay, choose to hand us?

    There is a not at all fine line between reporting and propaganda. And it is high time the Barbados Fourth Estate realised that it is no longer possible for them to continue to espouse and propagate the tactics of their collective patron saint, one Dr. Paul Joseph Goebbels (politician and Reich Minister of Propaganda in Nazi Germany from 1933 to 1945). Or do you think that millions of people, including the late Rt Excellent Errol Barrow, were wrong to fight Goebells and his cohorts, so that all of us could enjoy a free and unbiased fourth estate, among other advantages, of a free society?

    By the way, do you find the comments of the Commissioner on the matter of Principal Broomes and the marbles to be correct. Your answer to that would be revealing as to your own wealth in marbles. Personally, I found the comment unbearably priggish.

    well Broomes lawyers lost no time during the inquiry letting the commissioners know of their probale inteny of waging court through the court maybe in such binstance what’s good for the goose is also good for the gander. however the COI purpose was to collect information and present their findings .so all the wishy washy back and forth can’yt alter the testimony. so i guess it will be up to broomes lawyers to drag the matter on into eternity i am hoping that those teachers wo felt arggrieved by Broomes would countersuit him personally.

    AC never once did i ever infer that broomes does not deserve the best and yes the most aggressive counsel necessary. however when the BSTU does similiar all hell breaks loose by those who is supporting Broomes. and a kangroo court is set up here on BU by some of his counsel outside of my opinions i will wager a bet that no lawyer have contacted BU or any BSTU officer has asked any special privilege of presenting the teachers side through articles on BU but that shows the difference in the bstu and their professionalism , can’t say the same for broomes counsel

  49. I note with interest that the BSTU ‘s letterhead suggests they are domiciled at the Lodge School.Does any quality teaching go on at that school?A whole lot of hogwash, to quote a former minister and knight. Trade unionism will destroy this little country,mark my word.

    In this information and interconnectivity age that also shows their ignorance. Rest assured, were I a leader of an institution or organisation and people like ac waged an online propaganda war against it potentially to its detriment and that of its members, agenda or objectives I’d be duty bound to employ whatever tactics and information were necessary to set the record as straight as well I could. For transparency of course 🙂
