Prime Minister Fruendel Stuart

There is a rising concern about the level of integrity demonstrated by people in high office in Barbados. Such concern is usually targeted at government officials. Not since the late Rt. Hon. J.M.G.M “Tom” Adams, Q.C., M.P failed to enact integrity legislation in the 70s  have we had a Prime Minister who has demonstrated the testicular fortitude to put Transparency Legislation on the statute books.  The Honourable Prime Minister Fruendel Stuart Q.C, M.P maybe the man to do it.

When the Prime Minister announced recently that the Prevention Against Corruption Bill is coming, it caused the political cynics to snigger. BU believes Stuart is serious about delivering the legislation. This is a man who exudes honesty and integrity when compared to his parliamentary colleagues.  He appears to be the type of man who will do what is right and let the chips fall way they may. His biggest challenge maybe within his own team and he will therefore have to drag a few kicking and screaming to the party.

If Stuart can operationalize Transparency Legislation in Barbados – win, lose or draw come general election time, he will command a special place when political history is recorded. However, there is another matter which he needs to put to bed to reinforce the perception that he is a man of integrity. He must inflict Stage II on the Alexandra matter.

Now that the hysteria associated with the Alexandra impasse has subsided, it is time for rational analysis to rise to the fore. BU was chastised for sitting on the fence when we did not throw full support behind headmaster Jeff Broomes. Our position is simple, as headmaster responsible for the administration of the school he did not ‘manage’ the situation effectively. Consequently under his stewardship the reputation of the St. Peter  institution was dented.

There is the the flip side of the issue.

On BU we pride ourselves in distilling issues especially the legal component. There is a strong view in the legal fraternity that no legitimate industrial action should have been taken by the BSTU because Jeff Broomes did not violate the terms of employment of the teachers and therefore there was no grounds for industrial action.

The BSTU took strike action on the grounds that it wanted Broomes removed which, unless Mr Broome had broken the terms of his own employment, did not make sense. In summary if Broomes had not broken his own terms of employment or the terms of employment of the teachers the BSTU was not within its rights to take industrial action. The teachers by striking were the ones to breach.

The legal argument however does not negate the sympathy which many have for the teachers in what turned out to be a black eye for the school. Barbadians continue to wait for Prime Minister Stuart to put the icing on the Alexandra cake. It is a matter of integrity.

    For sure though, this will be ONE interesting elections….one sided as well..these guys( DLP) just seem hell bent on losing.Why would I want to make yet another PROMISE that I have no real timeintention to keep ? Do I want to go down in history as the PM who could not keep a promise?

    I have always maintained that we cannot truly call ourselves independent when we have an Englishwoman as our Head of State, and we have to revert to her when we want justice. It is nothing but an institutionalized constitutional inferiority complex that would want is to depend on others in this way. If for no other reason than completing our independence, we need the CCJ and a local Head of State. We are saying to ourselves that we are not good enough. However that does not mean that we should staff the court with lazy people who fail to do the necessary research to deliver sensible judgments.

    On the other hand there is no such need for integrity legislation. It was merely an election gimmick because the DLP thought that it would have swayed voters who refuse to think for themselves. They are not really seeking to put any new offences on the law books. The corrupt practices that the bill addresses are already against the law. We did not need integrity legislation: we need enforcement.

    The legislation calls for a declaration of assets to be used as a ‘reference point’ no doubt.

    Where in the existing laws does similar apply?

    The answer to your question is, “No”. An employer would be in seeking to breach your contract if he assigned work that is outside your job description. Mind you, if you accept and perform those duties you cannot change your mind and then refuse. You would have accepted the variation in your contract of employment. They now become part of your duties.

    Owen and Mia declared their assets but do you and most barbadians believe that the assets declared were totally accurate and reflected true market value?

    Declaration of assets is important but has to be ironclad where, e.g., independent assessors certify that the declaration reflects reasonable reality.

    Can you point us to a URL with the draft IL legislation and let us see how tightly it is written?

    I am sure Mia’s declaration of her personal assets was correct. She has no reason to hide assets when her future Inheritances will be far more valuable.

    Owen is an honourable man who surrounded himself with honourable Barbadians like annister and icholls who would have advised him to declare all of his assets.

    Interesting especially with the large number of Bajans who are bastards like me.
    Then there are friends who are like close family.

    Lots of “safe havens” for “assets”.

    That is why IL must have enough “teeth” to do a forensic audit if there is the appearance of impropriety.

    WRT to Reference to the ‘late Bush Tea’, …any rumors about the Bushman’s passing are greatly exaggerated…..but it is good to be missed 🙂

    When you see, “And any other duties” written in a job description, it does not mean that the employer could give the employee anything to do. The other duties must relate to the other items in the job description. For example, if you employ a maid and her duties are itemized in a job description, let’s assume that one of those duties is mopping: you do not have to include an item in the job description that requires the maid to catch the water in the mop bucket, but she could not refuse to catch the water because that is not written in the job description. Similarly, if you employ a financial controller, the employer could not reasonably assign a duty to mop.

    If I may please identify the elephant in the room…

    The Late (Great?) Thompson promised two things to the electorate: Integrity Legislation, and a Freedom of Information Act. Promised to be delivered within 100 days of his being elected.

    Neither were delivered.

    But I find it very interesting that we’re so focused on the former, while the latter has effectively been forgotten.

    The former falls out of the latter — FOI is the most important broken promise.

    I would argue that if Stuart wants to make his mark on the good he has done for Barbados (while he can), he would focus on FOI.

    I missed the fact that he (FS) only promised PoC and IL. Question begs, can corruption be uncovered and lack of integrity proven without requisite freedom of information in place? If the answer is no, then you have introduced a very relevant elephant.

    Maybe wrongly so but whenever mention is made of ‘transparency legislation’ it is meant to include both FOI and I’ll. You are correct however that there is an emphasis on integrity legislation.

    That is technically & legally the accepted position “in theory”. However, Caswell, sometimes the reality of the situation could be far different. I don’t know if any “financial controllers” with a family waiting at home for the next meal who would be willing to bet that he could refuse to “mop” and still have a job. With my experience of the job climate/employers in Barbados that fellow’s employers have been known to then make it a priority to find some way or ways of terminating (victimising?) that person without a word being said by the authorities. So now out of work, that person is left scrambling to seek another job which maybe very difficult to land these days. Ah lie? Bullying does not only occur in school, Caswell it is also alive and well in the work place today.

    The DLP hasn’t used the words “transparency legislation” and FS was pointed in mentioning PoC and IL as opposed to the additional FoI. I’m curious as to whether they intend to bring both… Did the original PoC bill mention anything about FoI??

    Careful David. You are dealing with lawyers here, who are artists with language…

    Please remember that the fundamental point of Freedom of Information is everything produced using public funds should be publicly known.

    Every “first world” democracy has a form of FOI.

    Barbados claims to be a democracy, and aspires to be “first world”.

    Thus, I would argue there is something a bit weird about the fact that Barbados does not yet have a FOIA on the books….

    Agree with you. The obvious corporate governance deficit exposed by CLICO makes transparency legislation (PoC and FOI a priority. What harm can it do? We cannot have business as usual.
