It’s a long weekend and people will be making merry in the streets and between the sheets. Speaking of sheets here is a fascinating case and since BU is home to many legal experts – some with formal training and the majority trained at the “school of hard knocks”- I thought that I’d bring it to their attention to get feedback on an interesting legal argument.

Seems an Australian woman who was travelling on a work assignment decided to get it on with an acquaintance at the motel where she was staying, while they were playing “hide the sausage” the light fixture fell off the ceiling onto her face causing injuries to her mouth and nose.

Now her lawyer is appealing a ruling from the Workmen’s Compensation Board which denied her claim for compensation for the injury. It seems that the claim hinged on the fact that she was travelling on business and “sex is an ordinary lawful incident of life”.

  1. A interesting case, it seems the act occurred in the Motel which was booked by her department. It is reasonable to expect that if she wanted to play ‘hide the sausage’ she should have checked in to another Motel on her own tab. It is akin to having sex on the job, not good office decorum is it?

    Well Sarge, a large irony, is it not, that you would be so deeply interested in this salacious, really low-classed piece of the “lowest common denominator?”

    Thinking Barbadians ….., currently faced at every turn, with an unprecedented and ever-increasing high cost of living, that this “Guhment” (a la Donville Inniss pronounciation) seems incapable of addressing, and a burgeoning barage of societal ills, are occupied with far more worthy pursuits. Evidently, this stupid “lowest common denominator” stuff titilates you Sargeant. Who is the one that’s really be-fouling this blog?

    Why don’t you enlighten us of the context of my statement about your submission? Didn’t you interject comments about “lesbianism”, “pooching back” and “wukking up” into the discussion following Elombe’s post?

    What was the gist of Elombe’s post? Did it have anything to do with those subjects? How were the bloggers responding?

    Where did I submit my post? Was it in the midst of a discussion about any subject? David could have ignored it or promote it as he wished. I didn’t try to divert any one’s attention from any post by dragging the smelliest of red herrings across the pages in an attempt to smear a political opponent.

    I said as usual and I meant what I said, I don’t have to try to besmirch your character you are doing a good job on your own.

    Tell the BU family if you ever returned the $ 25,000.00 you took three days yes he took $ 25,000.00 three 3 days before the last elections to get a person named Mr Boolani his immigration status sorted out, which he never fullfilled or delivered on but in all of this when the Mr Boolani kept asking back for his money he never repaid the goodly gentleman, Symmonds you are a scamp a rogue and a vagabond of the highest order.

    You sure you not at U of T or Osgoode Hall?

    Yours is the eaisest and most sensible solution. As a paying guest, the owner of the motel as occupier owes her a duty to ensure that the premises are as safe as reasonable skill and care could make them. Why argue difficult but laughable issues such as whether she was in-ter-course of employment and whether the injury “arose’ out of it…?

    but that is not her bone of contention. The fact that she says she was injured while being on the job is where she is seeking compensation from workman comp. for her injuries The question being does she have that legal right given how her injuries happen. If i were her i would request a jury trial as i see it they are two players in this event 1. is the job which brought her to that motel in the first place and most likely her injuries would not have occurred if she was not there in the first place. the sexual aspect of it just happen and her injuries still revolves around the fact that her job took her there in the first place.i think if she seeks court action workmans comp might bend under pressure


  11. But ac, she might not have been there if, according to some, Adam had not eaten the apple! Is she going to blame Original Sin for her injuries? To get worker’s compensation she would have to prove that she was in the course of employment or that the injury arose out of the course of employmet. The sex might be incidental, but did it not take her out of the course of employment? What if she had got pregnant unwillingly? Would it be different if she had been injured in the same way as she was while sleeping?

In this case her action that of being on the job brought her there .had it not for the said action she would not have been there .as a juror i think workmen comp should compensate her since her being there was not voluntary and in part due to her job.

      It is news because of the refusal of the compensation board to honour her claim.

      It is a matter which has been going since 2007, the international media in this case by giving highlight is helping no?

    D0NT you realise that when we gaze on other peoples problem in some way it makes it easier for us to deals with ours. in a small way it is some form of compensation knowing that we are not the only ones with a problem.
    To you it might not be serious but trying telling that to the person experiencing the problem.

  17. ok Chris Halsall here is something serious.

    Barbados imports goods from the USA and Canada. The goods originate in China, they are shipped to North America some are “repackaged” and “rebranded” and then shipped to Barbados.

    So Chris Halsall do you agree that a concerted effort should be made by Barbados importers to import directly from China?

    This could save Barbados some serious money if I am right.

    Please note that China is effectively on the other side of the globe from us. So either their products go through the US of A or they go through the EU before they reach us….

    Are you saying there are no cargo ships traveling to anywhere in the Caribbean from China? Not even to Trinidad?

    It would be interesting to find out if any Importer in Barbados is looking at ways to reduce the cost of imported goods. Then again as long as Bajans have money they will spend it so there is no incentive to reduce cost.

    Just blame de guvment fud de high prices.

    By the way, Sir Lloyd still in China?

    Not absolutely sure. But it would be a very long trip if they do.

    After all, China has access to the Pacific; we here in Barbados are in the Atlantic.

  22. There is a local company,( that is in Barbados ) I know of who ships building materials out of China, however it take fairly long from the confirmation of the order till delivery here. I’m sure if other companies explore the same avenues available and they can put together a full ship load of cargo, the waiting time will be less.


  23. As far as I know, the freight is higher in many cases than the cost of the product, yet it is waaaay cheaper than what is purchased from closer countries. Most of the products used in the region, Barbados included, are manufactured in China.Even much of the brand name shoes and cloths originate out of China, check the underside of the shoes for instance. Thailan is another source of quality cheap materials especially clothing

    Have you considered the concept of trans-shipment?

    It doesn’t always involve drugs.

    Sometimes it makes sense to put heavy loads onto a ship to transport across an ocean, and then put it onto a train to cross across a continent, and then to put it back onto a ship for final delivery to its destination.

    Is this actually difficult to understand?

    Have I considered trans-shipping? I’m NOT interested in trans-shipping anything, I was just stating that it happens on a small scale, if the concept is developed it MIGHT become easier. I imagine you are highly educated, but simple me also knows about many methods of trans-shipping, i once was responsible for shipping building materials and I used many methods of trans-shipping that are still available today so it is not hard for me to understand or digest, MR Halsall.

  31. I think that the woman should be paid her workmen’s comp, because her job took her to that hotel. Otherwise it would mean that employees away on their employer’s business would be force into abstinence. And to impose abstinence on an employee would be to impose an undue burden of the employee. Sex is a joyful part of everyday life and nobody should be forced into abstinence, whether they go home each evening or whether they are travelling on business.

I don’t bother about them, since I get on with my life with no thought about who are displease by what I say or do, once I’m happy with myself.     • Barbados is not a litigious jurisdiction compared to others therefore the comparison is not a good one.
